WE RESPECTFULLY OBJECT TO BILL 79, AND REQUEST <br /> THAT THE COUNCIL VOTE AGAINST PASSING BILL 79. <br /> Our objection to Bill 79 is based on the following: <br /> 1. There is no clear or rational nexus for the proposed parking requirements <br /> contained within the Bill. A nexus study must be prepared with supporting <br /> technical justification for any increases or decreases in parking requirements. <br /> 2. Property owners with existing zoning and approvals that have obtained <br /> discretionary permits have vested property rights. Imposing additional parking <br /> requirements is illegal under the U.S. Constitution's Fifth Amendment as <br /> interpreted by the U.S. Supreme Court. <br /> We appreciate the opportunity to comment on Bill 79, and appreciate your consideration <br /> of our comments. <br /> <br /> Respectfully, <br /> <br /> Brian G.
