~1MVV ar <br /> COUNTY OF HAWAII STATE OF HAWAII <br /> •,rr~Or~Mr <br /> RESOLUTION NO. 429 0'7 <br /> (Dt~r z ) <br /> <br /> A RESOLUTION REQUESTING THE DIRECTOR OF PUBLIC WORKS TO WORK WITH <br /> <br /> THE PLANNING DEPARTMENT, THE PUBLIC, AND THE HAWAII COUNTY COUNCIL <br /> TO UPDATE AND REVISE CHAPTER 3 OF THE HAWAII COUNTY CODE 1983 (2005 <br /> EDITION, AS AMENDED), RELATING TO SIGNS. <br /> WHEREAS, chapter 3, Hawaii County Code 1983 (2005 Edition, as amended), hereinafter <br /> "the sign code", requires revision; and <br /> WHEREAS, the Hawaii County Council is requesting that the Department of Public Works <br /> delay enforcing sign code infractions that are not in any public right-of--way and that do not impede <br /> traffic or do not pose a traffic hazard (sandwich boards that impair traffic or line of sight or are located <br /> improperly in a public right-of-way should be cited); and <br /> WHEREAS, Council Members have the duty to educate and inform the public on the <br /> provisions of the sign code; and <br /> WHEREAS, the responsibility of creating effective and fair policy is vested with the Hawaii <br /> County Council and therefore the Department of Public Works has been tasked to enforce a sign code <br /> that is inconsistent; and <br /> WHEREAS, the Mayor will ask his departments to review the sign code and ask the <br /> Department of Public Works to work with the Planning Department, the public, and the Hawaii <br /> County Council to crafr an ordinance that is more in tune with today's needs; and <br /> WHEREAS, the Mayor of the County of Hawaii agrees, understands, and supports the <br /> purpose of this resolution; now, therefore, <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the <br /> Director of the Department of Public Works, or a designated assistant, will work with the Planning <br /> Department, public, and the Hawaii County Council to review the sign code; and <br /> <br />
