MtY or M <br /> COUNTY OF HAWAII STATE OF HAWAII <br /> e~~' <br /> ~ri'aG'A~'~ <br /> RESOLUTION NO. 450 0`7 <br /> RESOLUTION ACCEPTING THE DONATION OF REAL PROPERTY, BEING A PORTION <br /> OF TAX MAP KEYS: (3)5-4-009:004 and 027, SITUATE AT KAPA`AU, IN THE DISTRICT <br /> OF NORTH KOHALA, COUNTY AND STATE OF HAWAII, FROM EWM INVESTMENTS <br /> LLC. <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII. <br /> WHEREAS, EWM Investments LLC is the owner of a parcel of land, containing an area <br /> of 0.740 acre, more or less, being a portion of Tax Map Keys: (3)5-4-009:004 and 027, situate at <br /> Kapa`au, in the District of North Kohala, County and State of Hawaii, more particularly <br /> described in Exhibit "A" and delineated on Exhibit "B" attached hereto; and <br /> WHEREAS, the Department of Parks and Recreation desires to provide recreational <br /> activities for the public in North Kohala; specifically, a skate park facility on the subject <br /> property; and <br /> WHEREAS, EWM Investments LLC is desirous of donating the subject parcel to the <br /> County of Hawaii to help facilitate the creation of the skate pazk; and <br /> WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter, provides that the <br /> Council may accept gifts, which include the donation of real property on behalf of the County of <br /> Hawaii. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF <br /> HAWAII that in accordance with Article XIII, Section 13-12 of the Hawaii County Charter <br /> (2000), the County of Hawaii accepts the donation of real property consisting of 0.740 acre, <br /> <br /> more or less, identified as being a portion of Tax Map Keys: (3)5-4-009:004 and 027, situate at <br /> Kapa`au, in the District of North Kohala, County and State of Hawaii, and more particularly <br /> <br /> described in Exhibit "A" and delineated on Exhibit "B" attached hereto, from EWM Investments <br /> LLC. <br /> <br />
