YY •I <br /> COUNTY OF HAWAII STATE OF HAWAII <br /> RESOLUTION NO. 501 O$ <br /> A RESOLUTION EXTENDING THE TEMPORARY DELAY OF COUNCIL ACTION <br /> ON REZONING APPLICATIONS IN THE DISTRICT OF SOUTH KOHALA UNTIL <br /> THE SOUTH KOHALA COMMUNITY DEVELOPMENT PLAN IS ADOPTED BY <br /> ORDINANCE, OR DECEMBER 1, 2008, WHICHEVER SHALL OCCUR FIRST. <br /> WHEREAS, Resolution No. 17-07, duly adopted by the County Council on January 4, <br /> 2007, temporazily delayed Council action on rezoning applications in the District of South <br /> Kohala to allow time for the South Kohala Community Development Plan to be completed; and <br /> WHEREAS, Resolution No. 17-07 stated that the temporary delay would expire upon <br /> adoption of the South Kohala Community Development Plan by ordinance, or January 5, 2008, <br /> whichever would occur first; and <br /> WHEREAS, though the original delay termination date of January 5, 2008, has expired, <br /> the South Kohala Community Development Plan process is still ongoing and an extension of <br /> time is necessary to allow for completion of this important community-based process; and <br /> WHEREAS, though Resolution No. 17-07 included a provision that would allow for <br /> extensions of time in increments of not more than six (6) months each, the development of such <br /> plans have shown to necessitate a longer period of time; and <br /> WHEREAS, this resolution would extend the temporary delay of Council action on <br /> rezoning applications in the District of South Kohala until the South Kohala Community <br /> Development Plan is adopted by ordinance, or December 1, 2008, whichever shall occur first; <br /> now, therefore, <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, that <br /> Council action on rezoning applications in the District of South Kohala be delayed until the <br /> South Kohala Community Development Plan is adopted by ordinance, or December 1, 2008, <br /> whichever shall occur first; and <br /> BE IT FURTHER RESOLVED, that temporary delay of Council action on rezoning <br /> applications shall not affect or apply to any and all federal, State and County community-based <br /> and/or self-help housing projects involving agencies and programs including, but not limited to, <br /> <br /> the following: <br /> • The State Department of Hawaiian Home Lands housing projects in accordance with <br /> its December 30, 2002 "Memorandum of Agreement Between the County of Hawaii <br /> and the Department of Hawaiian Home Lands; <br /> • The State Housing and Community Development Corporation of Hawaii <br /> ("HCDCH") program; <br /> <br />
