ORDER OF RESOLUTIONS Res. 466-08: Amends Salary Ordinance No. 07-76 by Amending Section 3 Rates of Compensation, Deleting the Executive Pay Plan, and Amending Section 7.02(A) by Establishing Pay Rates for the County Physicians. {Amendment reflects a pay adjustment effective December 1, 2007, which will coincide with the compensation adjustments of the other executives whose pay is set by the Salary Commission.}; and FC-237. Res. 482-08 Authorizes Approval of In Lieu Fair Share Contribution to Satisfy Condition "K" of Ordinance No. 96 121. {Fair share contribution in an amount of $48,648 would be used for the support of road and traffic improvements, as required by Condition K; Hilo One, Inc., Applicant.}; and PC-61. Res. 483-08 Accepts the Dedication of Road Lots "A," "B," and "C" of the Kaha`olino Subdivision, Situate in Kalaoa, North Kona, County and State of Hawaii, Identified as Tax Map Key:(3)7-3-005:165, from Kaha`olino Partners, LLC. {Pursuant to Condition F of Ordinance No. 02-62, the following roadways have been improved to County dedicable standards: Road Lot "A" (Ki`eki`e Street) consists of 27,879 square feet, Road Lot "B" (Aka`ula Street) consists of 34,711 squaze feet, and Road Lot "C" (`Ili`ili Street) consists of 24,338 squaze feet.}; and PWIRC-50. Res. 486-08: Authorizes the Payment of Funds of a Later Fiscal Yeaz and More Than One Fiscal Year for aMulti-Year Lease of Office Space in Waimea. {The lease with Waimea Retail, LLC, is located within the Parker Ranch Center in Waimea, South Kohala (approx. 5,383 square feet) and would house the Finance Department's recently created Vehicle Registration and Licensing Division to provide basic vehicle registration and driver's license services.}; and FC-228. Hawaii County Council-29 Page 3 February 6, 2008 Res. 487-08: Authorizes the Acceptance of a Chlorine Recovery Vessel with Wheels and Two Chlorine Manuals to the Hawaii Fire Department. {Donated by Phoenix V LLC, dba BEI Hawaii (estimated value of $4,772); the Chlorine Recovery Vessel, used to contain leaks in chlorine cylinders and tanks, will be assigned to the West Hawaii Hazmat team.}; and FC-229. Res. 488-08: Authorizes the Acceptance of a Monetary Donation of $68 to the Hawaii Fire Department. {Donated by Edward J. and Jan S. Comstock, in appreciation of services provided by the Fire Department, the funds would be used to support emergency medical and rescue services.}; and FC-230. Res. 489-08: Authorizes the Payment of Funds of a Later Fiscal Year and of More Than One Fiscal Year for aMulti-Year (5 years) Lease of a Copier for the Office of Aging. {Current copier generates unsuitable copies and is beyond repair.}; and FC-232. Res. 490-08: Supports the Establishment of a Volunteer Fire Company and Unit Within the Kanehoa Subdivision of the South Kohala District. {The volunteer fire company would assist in the provision of fire fighting and educational resources for residents in the South Kohala community.}; and PSPRC-13. Res. 491-08: Supports H.B. 1598 Which Would Establish an Agency to Operate aSingle-Payer Universal Healthcare Insurance System. {Urges the Hawaii State Legislature to pass H.B. 1598.}; and PWIRC-51. Res. 492-08: Advances Funding Priorities to the Mayor for Inclusion in the 2008-09 Fiscal Year Operating Budget. {The funding priorities, which are listed in this resolution, are primarily regional and islandwide. The Council requests that it be included in the 2008-09 fiscal year operating budget, which will be submitted to the Council on March 1, 2008.}; and FC-236. Res. 496-08: Transfers/Appropriates an Appropriation Out and From the Designated Fund Account(s) and Credits Same to a Designated Fund Account(s). {Transfers/appropriates $1,250 out and from Clerk-Council Services-Contingency Relief account; credits same to Department of Parks and Recreation Elderly Activities Division (EAD) Special Programs Equipment Computer Equipment and Software (EAD Printers). Contingency Relief funds from District 5 would be used towards the purchase of 190 folding chairs and two folding chair caddies for the Pahoa Neighborhood Facility.} Res. 504-08: Authorizes Extension of the County of Hawaii Fuel Tax. {The County's current special fuel tax program will sunset on June 30, 2008, and the fuel tax of 8.8 cents would set the County fuel tax indefinitely due to the various and numerous highway needs and improvements to be made within the County.} (Note: Pursuant to HRS 243-5, the Council shall conduct a public hearing and public notice of the hearing shall be given in the County at least twice within a period of 30 days immediately preceding the date of hearing.) Bill 219 Amends the Parks and Recreational Facility Schedule, Chapter 15, Article 8, (Draft 2): Section 15-68.1, Hawaii County Code 1983 (1995 Edition, as Amended), by Renaming the Kona Scenic Park, in Honor of Clarence Lum Won, "Clarence Lum Won Park." {Commemorates and recognizes in perpetuity, Mr. Lum Won's significant contributions to the recreational programs in the community.}; and PSPRC-12. Bill 220: Amends Ordinance No. 07-82, as Amended, the Operating Budget for the County of Hawaii for the Fiscal Year Ending June 30, 2008. {Increases revenues in Contribution from Private Source ($68); appropriates same to Various Fire Contributions -Private.}; and FC-231. Hawaii County Council-29 Page 8 February 6, 2008 Bill 221: Amends Ordinance No. 07-83, as Amended, Relating to Public Improvements and Financing Thereof for the Fiscal Year July 1, 2007 to June 30, 2008. {Increases FINANCE: Earthquake Damages -Federal Emergency Management Agency (FEMA) [$1,200,000] ($2,050,000); fund increase shall be provided from Federal Grants Receivable ($850,000). An initial appropriation ($1,200,000) was approved last year for the FEMA funding resulting from the 2006 Kiholo earthquake; however, at that time only estimates were available from the State Civil Defense and FEMA. Most project amounts are now known, therefore, increasing the FEMA project appropriation to $2,050,000.}; and FC-233. Bill 222: Amends Ordinance No. 07-83, as Amended, Relating to Public Improvements and Financing Thereof for the Fiscal Year July 1, 2007 to June 30, 2008. {Funds will be re-appropriated to the following districts/categories as listed in "Exhibit B": Circle Island and Bridges Program ($3,746,020.60), Puna ($]84,621.69), South Hilo ($17,595.38), North Hilo ($70,783.67), Hamakua ($35,545.34), South Kohala ($4,256), North Kona ($500,226.87), South Kona ($90.28), and Ka`u ($36,397.36), for a total of $4,595,537.19; funds shall be provided from lapsed fuel tax funds, as listed in "Exhibit A", for various appropriations established by Ordinance Nos. 00-139 ($1,029.50), 01-26 ($4,856.20), 01-105 ($661.305.31), 03-62 ($2,356,161.30), 03-165 ($1,356,858.93), and 04-131 ($215,325.95), for a total of $4,595,537.19. Funds are lapsed fuel tax funds from the past fiscal years, dating back to Fiscal Year 1994-96 and up to Fiscal Year 2002-04. These funds would be appropriated back into the highway/traffic division projects within the island districts and to the Circle Island and Bridge progam.}; and FC-235. Bi11226: Amends Ordinance No. 07-83, as Amended, Relating to Public Improvements and Financing Thereof for the Fiscal Year July 1, 2007 to June 3Q 2008. {Adds DEPARTMENT OF PARKS AND RECREATION: Pahoa Neighborhood Facility playground equipment ($76,000); funds shall be provided from General Obligation Bonds, Capital Projects Fund -Fund Balance and/or Other Sources (Contingency Relief) ($76,000). Funds would be used for the installation of playgound equipment and required rubber matting at the Pahoa Neighborhood Facility.} Bill 227: Amends Ordinance No. 07-82, as Amended, the Operating Budget for the County of Hawaii for the Fiscal Year Ending June 30, 2008. {Increases revenues in the following: Housing Choice Voucher Program ($2,500,000) and Fund Balance - Housing Assistance Payments ($384,680), for a total of $2,884,680; appropriates $2,884,680 to Voucher Rental Subsidies.} Bill 232: Amends Ordinance No. 07-82, as Amended, the Operating Budget for the County of Hawaii for the Fiscal Year Ending June 30, 2008. {Appropriates revenues in Federal Grants -Interrogation Room Equipment ($52,000); appropriates same to Interrogation Room Equipment.} Hawaii County Council-29 Page 9 February 6, 2008 Bill 233: Amends Ordinance No. 07-82, as Amended, the Operating Budget for the County of Hawaii for the Fiscal Year Ending June 30, 2008. {Appropriates revenues in Federal Grants -Tsunami Model Community Program ($40,000); appropriates same to Tsunami Model Community Program. The purpose of the National Tsunami Hazard Mitigation Program is to provide funding to coastal states for tsunami mitigation initiatives to lessen the loss of life and damage to property. Funds would be used to initiate a model community pilot project to create a culture of preparedness and response in the community of Hilo.} Bill 234: Amends Ordinance No. 07-82, as Amended, the Operating Budget for the County of Hawaii for the Fiscal Year Ending June 30, 2008. {Increases revenues in Transfer from General Fund ($20,000); appropriates same to Wastewater -Other Current Expense (Ka Hale O Na Keiki Preschool Project). Contingency Relief funds from District 1 would be used as a grant for the Ka Hale O Na Keiki Preschool (project) who has been mandated to close its large capacity cesspool, consequently tearing up the playground and tricycle pathway. The Council adopted Resolution 436-07 on December 19, 2007, which transferred $20,000 from the Clerk-Council Services Contingency Relief account to the Sewer Fund.} 1:30 P.M.: STATEMENTS FROM THE PUBLIC ON ORDER OF THE DAY (SECOND OR FINAL READING) AND REPORTS ORDER OF THE DAY (SECOND OR FINAL READING) Bill 210: Amends Ordinance No. 07-82, as Amended, the Operating Budget for the County of Hawaii for the Fiscal Year Ending June 30, 2008. {Appropriates revenues in Federal Grants -Organized Crime Drug Enforcement Task Force ($20,000); appropriates same to Organized Crime Drug Enforcement Task Force.} Bill 211: Amends Ordinance No. 07-82, as Amended, the Operating Budget for the County of Hawaii for the Fiscal Year Ending June 30, 2008. {Increases revenues in Contribution from Private Source ($18,199); appropriates same to Fireman's Fund Training Grant.} Bill 212: Amends Ordinance No. 07-82, as Amended, the Operating Budget for the County of Hawaii for the Fiscal Year Ending June 30, 2008. {Appropriates revenues in Federal Grants -Justice Assistance Grant 2007 ($109,370); appropriates same to Justice Assistance Grant 2007. Funds would be used to develop a Documents Management System to electronically scan police reports, upgrade the Police Department's current system of storing police reports, and purchase a new portable Alternate Light Source kit for its crime laboratory.} Bill 213: Amends Ordinance No. 07-82, as Amended, the Operating Budget for the County of Hawaii for the Fiscal Year Ending June 30, 2008. {Appropriates revenues in State Grants -Pahoa Weed and Seed ($100,000); appropriates same to Pahoa Weed and Seed.} Hawaii County Council-29 Page 10 February 6, 2008 Bill 214: Amends Ordinance No. 07-83, as Amended, Relating to Public Improvements and Financing Thereof for the Fiscal Year July 1, 2007 to June 30, 2008. {Increases ENVIRONMENTAL MANAGEMENT: Queen Lili`uokalani Village Large Capacity Cesspool Replacement -County [$850,000] ( 900 000); fund increase shall be provided from General Obligation Bonds, Capital Projects Fund -Fund Balance and/or Other Sources ($50,000). Additional funds would be used to complete the design of the on-site portion of the collection system for the Queen Lili`uokalani Village subdivision to the off-site sewer system which in turn will connect to the Kona Sewer system at Keanalehua Street ($30,000) and for a contingency fund to cover possible additional design work as the project progresses ($20,000).} Bill 215: Amends Ordinance No. 07-83, as Amended, Relating to Public Improvements and Financing Thereof for the Fiscal Year July 1, 2007 to June 30, 2008. {Increases ENVIRONMENTAL MANAGEMENT: Honoka`a Large Capacity Cesspool Replacement -County [$500,000] ( 695 000); fund increase shall be provided from General Obligation Bonds, Capital Projects Fund -Fund Balance and/or Other Sources ($195,000). Additional funds would be used for additional design services ($100,000), for a design contingency ($85,000), and for consultant services to acquire sewer easements ($10,000) in order to connect lots in the Honoka`a town area currently serviced by large capacity cesspools, to a collector system serviced by a wastewater disposal system.} Bill 216: Amends Ordinance No. 07-83, as Amended, Relating to Public Improvements and Financing Thereof for the Fiscal Year July 1, 2007 to June 30, 2008. {Increases ENVIRONMENTAL MANAGEMENT: Komohana Heights Lazge Capacity Cesspool Replacement -County [$1,658,000] ( 1 688 000); fund increase shall be provided from General Obligation Bonds, Capital Projects Fund -Fund Balance and/or Other Sources ($30,000). Additional funds would be used to design a retaining wall along the newly acquired sewer easement (approved in Resolution 398-07) to accommodate the construction of a gravel access roadway for maintenance purposes and to reduce a wider encroachment onto the private property, and for a contingency fund to cover possible additional design work as the project progresses.} Bill 223: Amends Ordinance No. 07-83, as Amended, Relating to Public Improvements and Financing Thereof for the Fiscal Yeaz July 1, 2007 to June 30, 2008. {Increases PUBLIC WORKS: Highway Administration Building Extension [$200,000] ( 400 000); fund increase shall be provided from Highway Fund and/or Other Sources ($200,000).
