<br /> <br /> <br /> <br /> <br /> <br /> §328J-B Prohibition in certain places open to the public. <br /> <br /> Smoking shall be prohibited in the following areas open to the <br /> <br /> public: <br /> <br /> (1) Public beaches and public parks; and <br /> <br /> (2) In any area where smoking is otherwise not prohibited, <br /> <br /> any place within twenty-five feet of playground <br /> <br /> equipment installed for public use by children, play <br /> <br /> pits, play structures, bleachers, backstops, sports <br /> fields, ball diamonds, basketball, handball, tennis, <br /> <br /> and paddle tennis courts, and areas in which notice is <br /> <br /> posted that permits are required to reserve the area <br /> <br /> for picnics." <br /> <br /> SECTION 2. This Act does not affect rights and duties that <br /> <br /> matured, penalties that were incurred, and proceedings that were <br /> <br /> begun, before its effective date. <br /> <br /> SECTION 3. In codifying the new sections added by section <br /> <br /> 1 of this Act, the revisor of statutes shall substitute <br /> <br /> appropriate section numbers for the letters used in designating <br /> <br /> the new sections in this Act. <br /> <br /> SECTION 4. New statutory material is underscored. <br /> <br /> SECTION 5. This Act shall take effect upon its approval. <br />
