Bill 236 was submitted via Communication No. <br /> 997 dated January 29, 2008, from Mayor Harry Kim. The proposed amendments outline <br /> mitigation measures that are necessitated as the result of amending the portion of Condition L.4 <br /> of Ordinance 96-8 relating to the construction of a barricade or breakaway gate to prevent the use <br /> of Haleki`i Street as a vehicular thoroughfare prior to the opening of the entire Mamalahoa <br /> Bypass. <br /> <br /> The proposed amendments to Bill 236 are to existing Condition L.4 and L.5 and to create new <br /> Conditions L.6 - L.10, are illustrated via Ramseyer format, and read as follows: <br /> <br /> "(4) construct the extension of Haleki`i Street through the subject property as <br /> <br /> generally reflected in Exhibit "B", which phasing of improvements shall <br /> be approved by the Department of Public Works. The use of [14alekr i] <br /> <br /> Haleki` i Street as a public vehicular thoroughfare prior to the opening of <br /> the entire [Nilamalakea] Mamalahoa Bypass shall not be allowed prior to <br /> <br /> the enactment of an ordinance establishing interim controls and mitigation <br /> measures; <br /> <br /> Gomm.
