J~SY~OF H,~1 <br /> • ~ ~ ~~~ilirJ, <br /> <br /> COUI\T°I~'Y OF I~AWAI`I ~TAT'~ OF I~AWAI`I <br /> ,Tt Ci•N~•d1 <br /> BILL NO. z~i <br /> OIZDINA.NCE NO. <br /> AN ORDINANCE AMENDING CHAPTER 7, ARTICLE 2, OF THE HAWAII COUNTY <br /> CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO CIVIL DEFENSE DISASTER <br /> CONTROL. <br /> SECTION 1. The purpose of this measure is to increase the effectiveness of civil defense <br /> ordered evacuations during impending disasters or disasters by amending section 7-6, <br /> definitions, to add Civil Defense Agency designees as authorized persons. <br /> SECTION 2. Section 7-6, Hawaii County Code 1983 (2005 edition, as amended), is <br /> amended to read as follows: <br /> Section 7-6. Definitions. <br /> As used in this article: <br /> (1) "Authorized person" means any: <br /> (a) Police officer or County or State employee assigned to disaster <br /> duty during an impending disaster or disasters; <br /> (b) National Guard members; <br /> (c) Civil defense agency personnel, volunteers[.],or designees. <br /> (2) "Disaster" means any situation, usually catastrophic in nature, where <br /> numbers of persons are plunged into helplessness and suffering and <br /> as a result may be in need of food, clothing, shelter, medical care, or <br /> other necessities of life, and the governor of the State or the mayor <br /> of the County has declared a state of disaster or emergency. <br /> (3) "Impending disaster" means any situation where a catastrophe <br /> threatens an inhabited area and the civil defense agency has issued a <br /> warning that the inhabitants of the area should evacuate from the <br /> threatened area. <br /> SECTION 3. Material to be repealed is bracketed and stricken. New material is <br /> underscored. In printing this ordinance, the brackets, bracketed and stricken material and <br /> underscoring need not be included. <br /> SECTION 4. Severability. if any provision of this ordinance, or the application thereof <br /> to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or <br /> applications of the ordinance which can be given effect without the invalid provision or <br /> application, and to this end, the provisions of this ordinance are declared to be severable. <br /> <br />
