Contributions Annual Report as of June 30, 2007. This report provides the reconciled balanq*
the fair share account as of June 30, 2007 and updates the last report (dated May 25, 2007) that
provided the balance as of June 30, 2006.
The primary intent of this annual report is "for the council's review and use in the formulation of
the capital budget" (Hawaii County Code section 2-162.1(a)). The fair share contributions are the
most significant of all community benefit assessments and exactions in terms of generating a
revenue source or in-kind contributions for capital improvements. We hope this report will be
useful to the Council and administrative agencies to tap the fair share contributions account as an
additional funding source for appropriated projects.

PREFACE
Pursuant to Hawaii County Code section 2-162.1, which requires the Planning Department to submit
an annual report on all community benefit assessments and exactions', this report summarizes fair
share assessments, collections, and expenditures for the Council's review and use in the formulation
of the capital budget. Fair share contributions collected in cash should be expended within the
district of the assessed project for capital projects with regional benefits (nexus requirement).
The following summarizes the fair share contributions assessed, collected, and expended:
• Total Assessed. Of the rezonings through June 30, 2007, fair share assessments totaled
$96,125,088.98 (see Table 1), However, it must be emphasized that this amount is based on the
proposed development at the time of rezoning, and the amounts are not due until subdivision or
plan approval based on the actual project built. When the amounts do become payable, the
Planning Department adjusts the initial assessments based on the actual number of units and the
consumer price index at the time of payment. Total assessments are as follows:
o North Kona ($50.OM)
o South Kohala ($20.3M)
o North Kohala ($8.4M)
o South Hilo ($7.IM)
o North/South Kona ($5.8M)2
o South Kona ($3.8M)
o Hamakua ($0.4M)
o Puna ($0.3M)
o North Hilo ($.02M)
o None in Ka'u.
From the date of the last report in 2007, new rezonings and associated assessments occurred only
in South Hilo, North Kona, and North Kohala. Table 2 is a detailed list of names, assessed
amounts, permit numbers,3 adjustments, and payment status.
• Payments Received. Table 3 summarizes the cash balance in the capital projects fund and the
park dedication fund, as well as the value of the in lieu assets credited. Table 4 provides a detail
of the transactions that tie in to the respective amounts listed in Table 3. Table 5 summarizes
The types of community benefit assessments and exactions imposed through Planning Department permit conditions
include: 1) fair share contributions exacted as conditions of rezoning approvals or Use Permits (cash or in lieu capital
improvements); 2) park dedication exactions pursuant to Hawaii County Code chapter 8 administered through
subdivision approvals (cash or land); 3) public access dedication exactions pursuant to Hawaii County Code chapter 34
(land in fee or easement) administered through subdivision approvals; and 4) golf course community benefit assessments
exacted as conditions of Use Permits.
x The Hokulia project straddled the North and South Kona districts, so these funds are available for projects in either
district.
In the tables, the numbers following colons refer to the Rezoning Number. With this number, the Planning Department
can determine the Ordinance No., applicant, and other information related to the rezoning.
In Table 2, the "unpaid" status does not mean that the Planning Department failed to collect the amount from the
applicant; rather, it means the property is undeveloped and that the applicant has not yet triggered the payment by a
subdivision or plan approval application.

• Cash. As of June 30, 2007, the cash balance in the capital projects fund was $4,869,900.67 and
the parks dedication fund was $89,000.00. Cash balances by capital improvement type are as
follows:
o Fire: $500,050.81
o Parks: $1,525,708.21
o Police: $313,200.02
o Solid Waste: $324,804.33
o Roads: $1,735,250.23 ($330,000 earmarked)
o Kaloko Mauka Roads: $470,887.04
• In Lieu. As of June 30, 2007, $22,146,623.33 has been credited in the form of improvements
paid by the applicant, planning or design services paid by the applicant for capital improvement
projects, land dedicated to the County or other approved entity, or cash paid to an approved non-
County entity. In some cases, the appraised value of the dedication exceeded the assessment
(see Table 6). The excess is available to the applicant to be applied towards satisfaction of future
fair share requirements that may be imposed on the applicant through future rezonings within the
district but does not entitle the applicant to any cash reimbursement.
• Expenditures. For purposes of this report, an expenditure is an appropriation or an allotment.
Expenditures from the capital projects fund totaled $2,689,207.31 for projects in North Kohala
(parks), North Kona (fire, parks, police, and roads), and South Hilo (parks) (see Table 7 for a
summary and Table 8 for more detail). The balance of the capital projects fund in Table 3
includes these expenditures.
