<br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> COUNTY OF HAWAII PLANNING DEPARTMENT <br /> RECOMMENDATION <br /> <br /> NANI MAU INC. <br /> AMENDMENT TO CONDITION B OF CHANGE OF ZONE ORDINANCE NO. 95-55 <br /> <br /> Upon careful review of the request against the guidelines for granting an amendment, the <br /> Planning Director is recommending that the Planning Commission send a favorable <br /> <br /> recommendation to the Hawaii County Council for the amendment request for a 5-year <br /> time extension and the request to delete the portion limiting the amount of 22 to Condition <br /> <br /> B of Change of Zone Ordinance No. 95-55 be modified to change the limit to 25, the new <br /> number requested by the applicant. Since this recommendation is made without the benefit of <br /> <br /> public testimony, the Director reserves the right to modify and/or alter this recommendation <br /> based upon additional information presented at the public hearing. This approval <br /> <br /> recommendation is based on the following findings: <br /> The applicant has submitted a 5-year time extension request to comply with <br /> <br /> Condition B (secure Final Subdivision Approval) of Change of Zone Ordinance No. <br /> 95-55, which would be from April 26, 2005 until April 26, 2010. Additionally, the <br /> <br /> applicant is requesting to delete the portion of Condition B that limits the maximum <br /> number of lots to 22. Condition B of Change of Zone Ordinance No. 95-55 states the <br /> <br /> following: <br /> "Plans for the proposed subdivision shall be submitted to the Planning <br /> <br /> Department and Final Subdivision Approval secured within five (5) years from <br /> the effective date of this ordinance. As represented by the applicant, the proposed <br /> <br /> subdivision shall not exceed a maximum limit of 22 lots. Upon the issuance of <br /> Final Subdivision Approval for the lots, the Planning Director shall initiate a <br /> <br /> change of zone of lands encumbered by the 9-hole pitch and putt golf course into <br /> an Open-zoned District classification." <br /> <br /> Nani Mau Gardens began with the approval of Docket No. SP73-159 (Special <br /> Permit No. 247) by the State Land Use Commission to Toyama Gardens Hawaii, Inc. dba <br /> <br /> Nani Mau Gardens, Inc. on October 17, 1973, which allowed the establishment of a <br /> <br /> -I- ATTACH: Comm. 1113 <br /> Bi11 274 <br />
