Arakaki, Chair <br /> <br /> RE: 1250 Oceanside Development Agreement <br /> <br /> I would like to recommend Section 15.c. and Section I5.c.(4) of the Development Agreement be <br /> revised on pages 22 and 24, respectively, to read as follows: <br /> <br /> "c. Funds for Reimbursement. During the course of this Agreement, if the <br /> <br /> COUNTY approves new rezonings in the vicinity of Mamalahoa Highway, then the <br /> <br /> COUNTY shall assess those new developments a "Fair Share" contribution in accordance <br /> <br /> with Council policy, or similar fee, to address the regional impacts of their development on <br /> <br /> road facilities. In the event <br /> <br /> "(4) As long as the COUNTY shall assess these new rezonings in the vicinity of <br /> <br /> Mamalahoa Highway a fair share contribution in accordance with Council policy, or if <br /> <br /> adopted, an impact fee, to address the regional impacts on their developments on road <br /> <br /> facilities, OCEANSIDE acknowledges and understands <br /> <br /> The reason for including this language is to limit the County's exposure by allowing fair share <br /> assessments in accordance with Council policy.
