<br /> <br /> <br /> March 24, 2008 <br /> Page 7 <br /> <br /> to the opening of the entire Mamalahoa Highway Bypass <br /> shall sunset upon the occurrence of either of the following: <br /> <br /> <br /> [w.]M[mkigatien] Mitigation measures outlined in <br /> [ ] Conditions <br /> M.4.a.(1-10) and MA.b.(1-7) above [age] have <br /> <br /> not been [eemplete] completed and fully <br /> implemented within twelve (12) months from the <br /> <br /> effective date of this ordinance; or, <br /> <br /> [I}](2)[flFief[ Prior to the expiration of the twelve- <br /> <br /> month period, the County Council determines that <br /> opening of Haleki`i Street Extension for use by the <br /> <br /> general public prior to completion of the entire <br /> Mamalahoa Bypass has proven not to be in the best <br /> <br /> interest of, and for the public good. <br /> <br /> In the event of sunset, amendments to the portion of <br /> <br /> Condition M.4 of Ordinance No. 96-7 relating to the <br /> construction of a barricade or breakaway gate to prevent <br /> <br /> the use of Haleki`i Street as a vehicular thoroughfare prior <br /> to the opening of the entire Mamalahoa Bypass, shall be <br /> null and void and the original provisions of Condition M.1 <br /> <br /> through M.5 of Ordinance No. 96-7 shall control and <br /> remain in full force and effect." <br /> <br /> <br /> <br /> <br /> 3. The final paragraph of Condition M is amended to change "AIN Drive" back to "Alii Highway", <br /> as council approved amendments to this paragraph should not have been included in proposed <br /> amendments set forth in Communication No. 997.4. Amendments to Bill 235 are limited by the title of <br /> the bill to Condition MA only. This final paragraph pertains to the entire Condition M. Therefore, the <br /> paragraph is amended to read as follows: <br />
