Ford, Council Member 9r- <br /> -c <br /> RE: Transmittal of Proposed Amendments to Bill 235, Draft 3, Relating to Amending <br /> Ordinance No. 96-7 by Amending the Portion of Condition MA Relating to the <br /> Construction of a Barricade or Breakaway Gate to Prevent the Use of Haleki`i Street as a <br /> Vehicular Thoroughfare Prior to the Opening of the Entire Mamalahoa Bypass <br /> <br /> <br /> There was an unfortunate oversight with regard to proposed amendments to Bill 235, Draft 2, as <br /> transmitted in Communication No. 997.10. The oversight is minor, thus requiring a housekeeping <br /> amendment to Bill 235, Draft 3. <br /> <br /> Specifically, Condition MA.c and Condition M.4.g.(1) contain incorrect citations to other conditions of <br /> Bill 235, Draft 3. <br /> <br /> Therefore, the following amendments are proposed, as illustrated via Ramseyer format and bolding: <br /> <br /> 1. Condition MA.c is amended to read as follows: <br /> <br /> "c. Commencement: Opening of Haleki`i Street as a public vehicular <br /> thoroughfare between the Mamalahoa Highway and the existing, northern <br /> section of the Mamalahoa Highway Bypass shall not be allowed until all <br /> mitigation measures outlined in Conditions M.4.a.(1-10) and JA4.4.b.( <br /> 7)] MA.b.(1-6) above have been completed and implemented. Upon <br /> opening Haleki`i Street for use by the general public driving eastbound <br /> from the Mamalahoa Highway Bypass, such traffic will only be allowed in <br /> a southbound direction on the Mamalahoa Highway Bypass to the Haleki`i <br /> Street Extension, and then eastbound on the Haleki`i Street Extension onto <br /> Cona No. q 99L <br /> Serving the Interests of the People of Our Island Ref.
