No. 1068Bi11263 <br /> PLACE: Sheraton Keauhou Bay Resort and Spa <br /> 78-128 Ehukai Street <br /> Kailua-Kona, Hawaii <br /> <br /> TIME: 9:30 a.m. <br /> Council Chair and Members <br /> Hawaii County Council <br /> <br /> Hilo, Hawaii 96720 <br /> Your Committee on Public Works and Intergovernmental Relations, to which was referred <br /> Communication No. 1068, regarding Bi11263, reports as follows: <br /> Bi11263, transmitted by Council member Brenda J. Ford, via Communication 1068 proposing an <br /> Ordinance to amend article XIII General Provisions, Section 13-11, Penalties, of the Hawaii <br /> County Charter (2000), Relating to the Clarification of Language regarding Civil Fines and <br /> Increasing the Maximum Monetary Penalty for Criminal Fines. <br /> Committee Chair Brenda J. Ford relinquished her seat to Vice Chair Dominic Yagong. <br /> Council member Ford presented the purpose of this ordinance is to increase the criminal penalty <br /> amount from $1,000, to an amount not to exceed $2,000. This bill also amends the section to <br /> clarify the County's authority regarding the imposition of civil fines. Furthermore, the Flooding <br /> Adhoc Committee voted to move this legislation forward to this committee. Council member <br /> Ford seeks the support of her colleagues on this proposed bill. <br /> There was no public testimony presented on this proposed bill. <br /> Council member Higa inquired as to how many fines as described have been levied during the <br /> past year by the County? Council member Ford responded that this proposed bill's is to correct <br /> bad behavior and prompt remedial action by those who are causing serious problems to the <br /> health and safety of public welfare by blocking floodways. <br /> Mr. Bill Takaba, Finance Director, appeared before your committee. Currently he is only aware <br /> of fines and penalties related to the Falsification of land records. However, throughout his eight <br /> years in the finance department he does not recall having ever levied a fine or penalty for the <br /> falsification of land records. <br /> PWIRC RPT NO. 64 <br /> <br />
