Wilkins <br /> To: Hawaii County Council <br /> <br /> The following information is to give members of the council a look at the <br /> wording of the charters of the three other counties in Hawaii in regard to <br /> whether an initiative can be amended or repealed by the council. <br /> <br /> <br /> Kauai County: No restrictions <br /> <br /> Maui County: Section 11-& Publication: Repeal and Amendment. <br /> <br /> Initiative ordinances enacted by the voter shall be published and shall take <br /> effect as prescribed for ordinances generally. Any ordinances enacted <br /> <br /> pursuant to this article may be amended or repealed by ordinance enacted <br /> after one (1) year from the date of certification, but only by the affirmative <br /> vote of at least two-thirds of the council membership. (Amended 2002) <br /> <br /> Honolulu County: Section 3405. Adoption, Effective Date and <br /> Limitation- <br /> <br /> <br /> 2. No Veto. No ordinance adopted by initiative power shall be subject to <br /> mayoral veto. <br /> <br /> 3. Limitation Against Council. No ordinance adopted by initiative power <br /> shall be amended or repealed by the council within two years after adoption, <br /> except as a result of subsequent initiative or by an ordinance adopted by the <br /> affirmative vote of at least three quarters of the entire council after public <br /> hearing. (Petition No. 17 (1982); 1992 General election Charter amendment <br /> <br /> Question No. 20) <br /> <br /> The wording that our committee has proposed is between the two extremes <br /> and seems quite reasonable when citizens have gone to such great effort to <br /> have an initiative passed.
