Motion to Reconsider and Override Veto, Public Hearing Tuesday, April 22, 2008
My name is Loren Amaral; I am with the Keaau Youth Business Center and REAL.
REAL is a statewide youth led movement against the tobacco industry. I strongly
support Bill 224 and commend the County Council for moving this visionary measure
forward in its current form. I applaud you for showing true leadership and vision in
passing Bill 224. I strongly urge you continue to show your leadership and override
Mayor Kim's veto. I want Hawaii County to be a clean and healthy place for my family
and I to enjoy. Bill 224 will protect my right to breathe clean air at all County of
Hawaii parks, beaches and recreational facilities.
I am in support of this Bill passing because the littering from cigarettes ruins our beaches.
My dad use to smoke, but when I was born he quit because he did not want to contribute
second hand smoke to me, and didn't want me around smoking. Despite progress made
in successfully legislating indoor tobacco smoke in workplaces, our keiki continue to be
exposed to the hazards of second-hand smoke in public places. Second-hand smoke is a
Class-A carcinogen - same as asbestos - there are no safe levels of exposure.
Last year, Kahalu'u Beach Park in Kona went smoke-free let's do the same for the rest of
the island. Passing Bill 224 will make visiting all County parks and beaches a more
pleasurable experience.
In conclusion I am in support of Bill 224 because I hate all the littering that comes from
smoking. I really want everyone to be able to breathe clean air, without second hand
smoke harming our health. Second hand smoke it a known health and environmental
hazard. The public's health should be protected wherever, possible, including while
enjoying Hawaii's parks and beaches.

I strongly support Bill 224 and commend the County Council for moving this visionary
measure forward in its current form. I applaud you for showing true leadership and vision
in passing Bill 224. I strongly urge you continue to show your leadership and override
Mayor Kim's veto. I want Hawaii County to be a clean and healthy place for my family
and I to enjoy. Bill 224 will protect my right to breathe clean air at all County of
Hawaii parks, beaches and recreational facilities.
I am a high school student who attends Keaau Youth Business Center, and a member of
REAL, a statewide youth led movement against the tobacco industry. I attend our
beaches and parks often with my family and friends.
This measure will also reduce toxic litter, and send the message that tobacco use is not
the norm in our community, so we stop sending keiki mixed messages about tobacco use.
Children and families deserve clean, healthy places to enjoy outdoor activities.
Visiting our parks, beaches and recreational facilities should be a pleasurable and safe
experience for all. Discarded cigarettes and cigar butts at our parks and beaches are
unsightly, unclean and particularly hazardous to small children and wildlife. A child
putting a toxic cigarette butt into their mouth should not be part of that experience.
Cigarettes and their packaging is number one litter item on our island. Cigarette butts are
composed of cellulose acetate, a form of plastic, which is estimated to take up to 25 years
to decompose on land and in the sand. It takes a cigarette butt 5 years to decompose in
the ocean. Cigarette butts can pose a deadly threat to wildlife. Indigestible cigarette
filters have been found in the stomachs of sea turtles, fish, birds, whales and other marine
creatures who mistake them for food, swallowing harmful plastic and toxic chemicals.
I don't like smoking at the beaches because of all the littering it is very gross. If the little
kids who attend the beach put it in their mouths it can hurt them.

My name is Roy Arizo I am a 16 year old high school student at Hilo High School. I am a
member of REAL. REAL is a statewide youth driven movement to fight back the tobacco
industry, which heavily targets my generation. I strongly support Bill 224 in its current form,
and I commend the County Council for moving this visionary measure forward. I applaud
you for showing true leadership and vision in passing Bill 224. I strongly urge you continue
to show your leadership and override Mayor Kim's veto. I want Hawaii County to be a
clean and healthy place for my family and I to enjoy. Bill 224 will protect my right to
breathe clean air at all County of Hawaii parks, beaches and recreational facilities.
I am a member of a break dancing crew with my friends. We practice break dancing at
Mohouli Park. Break dancing is a big part of my life; it is some what like MY anti-drug.
Sometimes, though our practice ends early, because of people using our beautiful park as a
place to take a break and light up. The smoke is horrible and it interrupts us. You can't
dance if you can't breathe. We are forced to move else where. There are not many places to
go to in Hilo and we enjoy being outdoors to practice, but we can't enjoy the park and be
forced to inhale all the toxins. Here we are trying to do the right thing with our spare time,
and we are subjected to second hand smoke, the rotting negative image that is portrayed
from smoking, and the litter to our place of refugee, and practice.
I ask you County Council members please don't allow our only places to practice continue to
be a smoking haven for others. Please let us youth enjoy our beautiful parks.

places.

My name is Melissa Chong I am a board member of REAL. REAL is a
statewide youth led movement against the tobacco industry. I strongly support Bill 224,
which would prohibit use of tobacco products at all County of Hawaii parks and beaches,
effectively providing a clean and healthy environment for Hawaii's keiki, ohana, visitors
and wildlife. I strongly support Bill 224 and commend the County Council for moving this
visionary measure forward in its current form. I applaud you for showing true leadership
and vision in passing Bill 224. 1 strongly urge you continue to show your leadership and
override Mayor Kim's veto. I want Hawaii County to be a clean and healthy place for my
family and I to enjoy. Bill 224 will protect my right to breathe clean air at all County of
Hawaii parks, beaches and recreational facilities.
I believe that if the beaches became smoke free less people on the Big Island would
become sick from second hand smoke. Myself as well as other members of the
community go to the beach to swim and enjoy the beautiful scenery, but not to have
smoke blown in our faces. There would be less litter on the beaches for us as beach
goers to step on. The animals that are on shore will also not get sick from eating the
cigarette butts. So please pass this law to keep all beaches smoke free to keep our
beautiful land clean and to keep everyone safe and healthy.
Last year, Kahalu'u Beach Park in Kona went smoke-free let's do the same for the rest
of the island. Passing Bill 224 will make visiting all County parks and beaches a more
pleasurable experience.
I am concerned of the welfare of the scenery and animals that are destroyed by the
effects of individuals rubbish from cigarettes. I want to be able to enjoy the beach
without worrying about getting ill from the smell of second hand smoke. Secondhand
smoke is a known health and environmental hazard. The public's health should be
protected wherever possible, including while enjoying HawaiTs parks and beaches.

My name is Alyssa Doctor and I am a youth member of REAL. REAL is a statewide
movement against the tobacco industry. I strongly support Bill 224, which would

I attend our County beaches and parks regularly with my friends and family. I hate the
smell of someone smoking. I feel like it is burning my entire nose. I hate the disgusting
odor that adheres to my clothing, hair, and skin causing damage to myself. It is very bad
for our environment; all the litter and chemical damage our beautiful earth. The animals
and sea life eat all the litter and it is deadly to their health. It is also valuable money that
is being spent to clean after all the individuals who choose to use our land and beaches as
their ashtray.

In conclusion, I hate to smell second hand smoke not only the risk of damaging effects to
everyone's health, it stinks. The environment and its inhabitants are in danger. The
money that is being spent to clean up the littered beaches and parks as well as help to
save these animals could be used to effectively, if people weren't allowed to ruin our
beaches. Secondhand smoke is a known health and environmental hazard. The public's
health should be protected wherever possible, including while enjoying Hawai'i`s parks
and beaches. It is the responsibility of government to protect the public's health,
including while enjoying Hawai'i's parks and beaches. Clean air is my right, and it must

Thank you so much for responding to our pleas to pass Bill 224 without a smoking-
designated areas amendment.
Mayor Kim has responded twice to my communications urging him not to veto the Bill. His
objections to the Bill ignore the wishes of the vast majority of Country residents and violate
their right to reduce exposure to second hand smoke and to toxic tobacco litter.

Good afternoon Chairman Hoffmann and Council Members. Thank you for the oppotunit3rb
present testimony today. My name is Cyd L. Hoffeld and I strongly support Bill 224. On Monday,
3/10/08,1 took a group of high school student on a field trip to Richardson Beach Park. The
purpose of the field trip was to clean the beach of trash including cigarette butts. We decided to
time the activity to see how much trash we'd collect within 1 hour. We ended up collecting 3
shopping bags full of cigarette butts alone. It was disgusting. Please help to keep our park grounds
and air clean of cigarettes and its waste.
Toxic litter from Cigarette butts and tobacco packaging we the number one litter problem we have
on our beaches. Ingesting cigarettes butts is harmful to young children, our coastal birds and marine
life. Toxins from cigarette butts leach into the ground and ocean.
Secondhand smoke is a Class-A carcinogen - same as asbestos, means it is known to cause cancer,
and there are no safe levels of exposure. Outdoor tobacco smoke is known to be as toxic as indoor
secondhand smoke and negatively affects children and adults with asthma, emphysema and other
health problems like heart disease.
Everyday, 3,000 youth become newly addicted tobacco users. Children get mixed messages about
tobacco use. Changing societal acceptance of tobacco use is needed through strong government
intervention in order to counter tobacco industry tactics.
Please override Mayor Kim's veto and make Bill 224 a law.

My name is Gabrielle Horttor and I am a member of REAL. REAL is a statewide youth
led movement against the tobacco industry. I strongly support Bill 224 and commend the
County Council for moving this visionary measure forward in its current form. I applaud
you for showing true leadership and vision in passing Bill 224. I strongly urge you
continue to show your leadership and override Mayor Kim's veto. I want Hawaii County
to be a clean and healthy place for my family and I to enjoy. Bill 224 will protect my
right to breathe clean air at all County of Hawaii parks, beaches and recreational
facilities.
I am in support of this Bill passing because I think that the littering left from smoking is
gross. People leave cigarette butts all over the place. Visiting our parks, beaches and
recreational facilities should be a pleasurable and safe experience for all. Discarded
cigarettes and cigar butts at our parks and beaches are unsightly, unclean and particularly
hazardous to small children and wildlife. A child putting a toxic cigarette butt into their
mouth should not be part of that experience. Cigarettes and their packaging is number
one litter item on our island. Cigarette butts are composed of cellulose acetate, a form of
plastic, which is estimated to take up to 25 years to decompose on land and in the sand.
It takes a cigarette butt 5 years to decompose in the ocean. Cigarette butts can pose a
deadly threat to wildlife. Indigestible cigarette filters have been found in the stomachs of
sea turtles, fish, birds, whales and other marine creatures who mistake them for food,
swallowing harmful plastic and toxic chemicals.
Last year, Kahalu'u Beach Park in Kona went smoke-free let's do the same for the rest of
the island. Passing Bill 224 will make visiting all County parks and beaches a more
pleasurable experience.
In conclusion I am in support of Bill 224 because I hate all the littering that comes from
smoking.

My name is Alana Jardine. I am a member of REAL the statewide youth led
movement against the tobacco industry. I applaud you for showing true
leadership and vision in passing Bill 224. 1 strongly urge you continue to show
your leadership and override Mayor Kim's veto. The veto of this Bill is
inconsistent with previous statements and budget priorities relating to health
care made by County Administration. By vetoing Bill 224, Mayor Kim is
perpetuating the health care crisis we are facing today.
I strongly support Bill 224, which would prohibit use of tobacco products at all
County of Hawaii parks and beaches, effectively providing a clean and healthy
environment for Hawaii's keiki, ohana, visitors and wildlife. I commend the

My family, friends and I love to enjoy our beaches, but it makes it difficult when
people are smoking where I choose to breathe. I have bad asthma and the
second hand smoke makes it worst. Little children put the remains of the
cigarettes into their mouths which is toxic for them. I love to enjoy our beautiful
beaches, but it is impossible when our beaches are littered with cigarettes. I want
to have fun not clean after someone else's littered cigarettes.
Last year, Kahalu'u Beach Park in Kona went smoke-free let's do the same for the
rest of the island. Passing Bill 224 will make visiting all County parks and
beaches a more pleasurable experience.
In Hawaii their a lot of people who suffer from asthma, we do not need more
efforts in suffocating us, by allowing others to smoke up our clean air.
Secondhand smoke is a known health and environmental hazard. The public's
health should be protected wherever possible, including while enjoying
Hawai i s parks and beaches. Children should be allowed to roam the beach
without having to stumble upon a cigarette. It is the responsibility of
government to protect the public's health, including while enjoying Hawaii s
parks and beaches. Clean air is my right, and it must be protected. Pass Bill 224
in its current form.

I use our beaches frequently and am disturbed to witness the harmful acts that follow
those who smoke at our beaches. The cigarettes get thrown into the ocean the fish,
crabs, or other sea creatures ingest the cigarette causing them to die, or worse we eat
contaminated fish. Birds take the cigarette rubbish back to their nests to feed to their
babies causing the baby birds to die. On one occasion while I was enjoying my day at
the beach relaxing someone started smoking a cigar. The cigar was really stink and I
couldn't handle the smell. Finally the person chose to extinguish the cigar and leave it
on the beach. I then had to pick up this stink cigar to throw it away in the rubbish.
Last year, Kahalu'u Beach Park in Kona went smoke-free let's do the same for the rest
of the island. Passing Bill 224 will make visiting all County parks and beaches a more
pleasurable experience.
I care about our island and its inhabitants I wish to preserve its natural beauty which
makes it difficult with all the cigarette related litter. The animals, sea creatures are in
jeopardy by ingesting this toxic. I am suppressed by other people's bad choices, when
all I want to do is breathe clean air. Secondhand smoke is a known health and
environmental hazard. The public's health should be protected wherever possible,
including while enjoying HawaiTs parks and beaches. It is the responsibility of
government to protect the public's health, including while enjoying HawaiTs parks and
beaches. Clean air is my right, and it must be protected. Pass Bill 224 in its current
form.

My name is Hye-ryeon Lee and I live at 3094 Kaloaluiki Street in Manoa valley. I am a health
communication researcher and on the faculty at the University of Hawaii at Manoa. I applaud you
for showing true leadership and vision in passing Bill 224. I strongly urge you continue to show
your leadership and override Mayor Kim's veto. The veto of this Bill is inconsistent with previous
statements and budget priorities relating to health care made by County Administration. By vetoing
Bill 224, Mayor Kim is perpetuating the health care crisis we are facing today.
Bill 224 in its current form has many benefits for all of us. Just to name a few, it supports precious
coastal and marine life by eliminating toxic debris that kill them; it supports clean, beautiful
beaches, parks and recreational facilities for all to enjoy, including visitors; it supports over 80% of
the population that choose not to use tobacco and breathe in deadly tobacco smoke with its 4,000
chemicals; it supports the 60% of smokers who want to quit by providing smoke-free outdoors free
of habit triggers by seeing or breathing in other smoke; and it supports a consistent message to
keiki, that tobacco use is an unhealthy and unacceptable life-style choice.
Once, after I spent some time talking about the dangers of tobacco use to a group of middle school
students, a students walked up to me and said, "I know what they say about smoking, that it is bad
for your health and that it can cause bad disease that can kill you. But, I don't really believe it,
because if it is really that dangerous, I think our government would have done something about it.,,
I was at a loss as to how to answer the question. Wouldn't you?
No matter what the opponents say, the bottom line is that Bill 224 is about protecting everyone's
right to breathe clean air and significantly reducing the toxic litter at our County parks, beaches and
recreational facilities. The policy proposed by Bill 224 is a good public policy from a public health
perspective, from a civil rights perspective, from an economics perspective, and from a plain old
majority opinion perspective. So, please do the right thing: Protect the health of public by
supporting Bill 224 and overriding the veto.

My name is Devin Liva, and I attend Keaau High school's peer education, and I strongly
support Bill 224, which would prohibit use of tobacco products at all County of Hawaii
parks and beaches, effectively providing a clean and healthy environment for Hawaii's
keiki, ohana, visitors and wildlife. I commend the County Council for moving this
visionary measure forward in its current form. I want Hawaii County to be a clean and
healthy place for my family and I to enjoy. Bill 224 will protect my right to breathe clean
air at all County of Hawaii parks, beaches and recreational facilities. I applaud you for
showing true leadership and vision in passing Bill 224. 1 strongly urge you continue to
show your leadership and override Mayor Kim's veto.
I am a student at Keaau High School and I attend our peer education program, and
REAL. REAL is a youth led movement against the tobacco industry. My family and I
also attend our beaches frequently.
When I am at the beach I see people smoking, and throwing all their butts on the ground.
It makes me angry that they are littering our beaches. By throwing their butts it subjects
a lot of things to being potentially threatened and killed. When I see a beach littered with
cigarette butts, I then choose not to frequent that beach.
Last year, Kahalu'u Beach Park in Kona went smoke-free let's do the same for the rest of
the island. Passing Bill 224 will make visiting all County parks and beaches a more
pleasurable experience.
In conclusion, I support this Bill 224 because; I do not want to see butts littering my
beaches. I do not want the environment and its inhabitants to become destroyed. I want
to be able to enjoy our beaches. Secondhand smoke is a known health and
environmental hazard. The public's health should be protected wherever possible,
including while enjoying Hawaii's parks and beaches. It is the responsibility of
government to protect the public's health, including while enjoying HawaiTs parks and
beaches. Clean air is my right, and it must be protected. Pass Bill 224 in its current
form.

As a concerned citizen, mother and grandmother, I strongly support the passage of Bill
224. Our education system teaches our children the dangers of tobacco and the benefits
of physical activity. As a health concern, higher instances of chronic diseases linked to
tobacco use are still presenting numbers that should not be ignored. Cancer, heart
disease, stroke, & emphysema are among these illnesses that can be prevented if tobacco
use is eliminated. Lung cancer is the most preventable of cancers simply by eliminating
tobacco use or not starting in the first place.
What kind of value is given the education our children are receiving if we do not support
the legislation that helps to ensure the best possible environment for them to be
productive leaders in the future? We live in a beautiful environment that encourages
healthy lifestyles. We need to encourage more of our community members to utilize our
natural resources in a way that benefits everyone. As responsible adults, we have the
capacity to be the role models that make conscious decisions to make the future as safe
and healthy for our keiki as possible and to maximize our natural resources to improve
the quality of life of our beloved community.
As a child, I remember endless summer nights spent camping on pristine beaches. Now
when I take my grandchildren to the beach, there are butts everywhere! When they are
playing in the sand and building sandcastles, they dig up cigarette butts! This is not the
kind of memories I want my grandkids to have of their outings on the beach!
Please accept my personal plea as written testimony in support of this bill.

My name is Hazel Nakano. I am a retired educator, mother, grandmother, and concerned citizen. I
commend you for your leadership and vision in passing Bill 224. 1 appreciate the time you've spent
individually and as a group in this effort. I've been following the hearings and the latest unfortunate
choice that Mayor Kim has taken regarding Bill 224. The veto of this Bill by the Mayor was a great
disappointment. By vetoing Bill 224, Mayor Kim is exacerbating the health care crisis we face
today. However, I am confident that you will continue to show your leadership and override Mayor
Kim's veto on April 22.
There are health issues that we face daily that we are not able to combat or remedy, but this is not
one of them. To some, this Bill may seem like a small issue in comparison to the many issues of
pollution and carcinogens in our environment, but the resulting positive impact it will have on our
aina and on our keiiki will be a legacy you can leave for a healthier future.
The akamai youth of today know that smoking is bad for everyone, and that the resulting opala
harms our environment. Let's show them that we care about them and we, the adults, know what's
the right thing to do. Let's show them that difficult decisions must be made to promote a healthier
lifestyle. Let's protect our marine life and eliminate toxic debris. Let's make our beaches and
recreational areas enjoyable and free of second hand smoke. Let's protect the 80% of the
population that choose not to use tobacco and breathe in deadly tobacco smoke. Let's do
everything in our power to make Hawai'i a healthy place for all to enjoy.

My name is Faith Rossman, RN, MN, a member of "Breathe Free." I applaud you for showing true
leadership and vision in passing Bill 224. 1 strongly urge you continue to show your leadership and
override Mayor Kim's veto. The veto of this Bill is inconsistent with previous statements and budget
priorities relating to health care made by County Administration. By vetoing Bill 224, Mayor Kim is
perpetuating the health care crisis we are facing today.
Bill 224 in its current form:
• Supports precious coastal and marine life by eliminating toxic debris that kill them
• Supports clean, beautiful beaches, parks and recreational facilities for all to enjoy, including
visitors.
• Supports clean air free of secondhand smoke, for which there is no safe level of exposure.
• Supports over 80% of the population that choose not to use tobacco and breathe in deadly
tobacco smoke with its 4,000 chemicals
• Supports the 60% of smokers who want to quit by providing smoke-free outdoors free of habit
triggers by seeing or breathing in other smoke
• Supports a consistent message to keiki, that tobacco use is an unhealthy and unacceptable
life-style choice
• Supports preventive measures in our current healthcare crisis
• Supports implementation and compliance, because it is easy to understand
• Supports a vision of a sustainable, healthy and prosperous community for all its citizens
Bill 224 is about everyone's right to breathe clean air and significantly reducing the toxic litter at our
County parks, beaches and recreational facilities. Bill 224 will still allow individuals to smoke and
use tobacco products - just not at our beautiful parks, beaches and facilities where keiki and their
ohana visit and would like to fully enjoy.
Please accept this as written testimony in support of this bill and override the veto.

My name is Jayshawn Smith I am a 15 year old high school student. I am a member of
REAL. REAL is a statewide youth driven movement to fight back the tobacco industry,
which heavily targets my generation. I strongly support Bill 224 in its current form, and I
commend the County Council for moving this visionary measure forward. I applaud you for
showing true leadership and vision in passing Bill 224. I strongly urge you continue to show
your leadership and override Mayor Kim's veto. I want Hawaii County to be a clean and
healthy place for my family and I to enjoy. Bill 224 will protect my right to breathe clean
air at all County of Hawaii parks, beaches and recreational facilities.
You may not realize it, but smoking.... second hand smoke affects every day life. My friends
and I break dance, and every time we try to practice at the parks we have to breathe in the
second hand smoke everywhere. It makes our practicing to dance hard with all the smoke in
the air, making it hard for us to breathe. The tobacco companies target youth and they
target our subculture of break dancing, as well as many different other talents. I am tired of
trying to dance and better myself by doing something positive and I be pushed out. I want
to be able to enjoy our beautiful island without having to in hale toxic smoke, and seeing the
litter, and the negative image. Hawaii is already heavily target by the tobacco industry we do
not need to help their efforts any further. Please support us youth, in passing this bill. I
want to be able to also give to my future generations a positive environment and this will
enhance that.
I ask you County Council members please don't allow our only places to practice continue to
be a smoking haven for others. Please let us youth enjoy our beautiful parks.
Please accept this as a written testimony in support of Bill 224 smoke free beaches and park
places.
