<br /> <br /> <br /> <br /> <br /> CONTRACTOR and the STATE, provided that change orders shall be made in <br /> accordance with paragraph 20 herein. <br /> <br /> b. No oral modification. No oral modification, alteration, amendment, change, or <br /> extension of any term, provision or condition of this Agreement shall be <br /> permitted. <br /> <br /> c. Agtgy procurement officer. By a written order, at any time, and without notice <br /> to any surety, the Agency procurement officer, subject to mutual agreement of <br /> the parties to this Agreement and all appropriate adjustments, may make <br /> modifications within the general scope of this Agreement to include any one or <br /> more of the following: <br /> <br /> (A) Drawings, designs, or specifications; <br /> <br /> (B) Method or place of delivery; <br /> <br /> (C) . Description of services to be performed; <br /> <br /> (D) Time of performance (i.e., hours of the day, days of the week, etc.); <br /> <br /> (E) Place of performance of the services; or <br /> <br /> (F) Other provisions of the Agreement accomplished by mutual action of the <br /> parties to the Agreement. <br /> <br /> d. Adjustments of mice or time for nerfonmance. If any modification increases or <br /> decreases the CONTRACTOR's cost of, or the time required for, performance <br /> of any part of the work under this Agreement, an adjustment shall be made and <br /> this Agreement modified in writing accordingly. Any adjustment in Agreement <br /> price made pursuant to this clause shall be determined, where applicable, in <br /> accordance with. the price adjustment clause of this Agreement or as negotiated. <br /> <br /> C. Claim barred after final ggyment. No claim by the CONTRACTOR for an <br /> adjustment hereunder shall be allowed if written agreemmt of modification is not <br /> made prior to final payment under this Agreement. <br /> <br /> f. Claims not barred, In the absence of an Agreement modification, nothing in this <br /> clause shall be deemed to restrict the CONTRACTOR's right to pursue a claim <br /> under this Agreement or for a breach of contract. <br /> <br /> g. CPO . If a modification, alteration, amendment, change or extension of <br /> any term, provision or condition of this Agreement increases the amount payable <br /> to the CONTRACTOR by at least $25,000.00 or ten per cent (10%) of the initial <br /> <br /> <br /> 13 Pw AG2-iC(IIW <br />
