There is no reference or <br /> discussion concerning any date upon which the amendment would take effect. Accordingly, the <br /> case law indicates that in these circumstances, the amendment becomes effective on the date the <br /> voters approved it. <br /> <br /> (2) The proposed ordinance establishing a maximum of two four year terms is <br /> acceptable. <br /> The proposed ordinance is acceptable. However, I recommend that Section 5 be clarified and <br /> rewritten. The ordinance must be as clear as possible in terms of what years of service will be <br /> counted towards the eight (8) year term limit. I understand that you may be interested in <br /> rewriting this section in light of my response to the first question. In that event, I would be happy <br /> to review any proposed language in an effort to avoid any future legal entanglements. <br /> <br /> Thank you for the opportunity to comment on this important matter.
