The Planning Commission, after a duly held public hearing on April 17, 1998, voted to
recommend for your approval the proposed legislative bill to change the district classification
for approximately 3.00 acres of land from Agricultural (A-3a) to Family Agricultural (FA-1a).
The property is located on the south side of Mamalahoa Highway across from the Nam
Waimea Subdivision, Puukapu Homesteads, Waimea, South Kohala, Hawaii.
The Commission concurs with the following Planning Director's reasons for recommending
favorable consideration of the change of zone:
In order to consider an area for any type of zoning designation, the applicable
goals, policies and standards of the General Plan must be adequately addressed. It is
only through such a comprehensive policy analysis approach that evaluations and
decisions can be made to better time and stage developments to achieve quality growth
determined by the General Plan and related planning documents. The implications of
these evaluations and decisions must also be considered as they may have an impact on
other similar areas in the County.
The proposed Change of Zone from an Agricultural (A-3a) to Family
Agricultural (FA-la) zoned district would conform to the following goals, policies and
standards of the Land Use and Agriculture Elements of the General Plan:

o Designate and allocate land uses in appropriate proportions and mix and in
keeping with the social, cultural and physical environments of the County.
o Protect and encourage the intensive utilization of the County's limited prime
agricultural lands.
o The County shall encourage the development and maintenance of communities
meeting the needs of its residents in balance with the physical and social
environment.
o Zoning requests shall be reviewed with respect to General Plan designation,
district goals, regional plans, State Land Use District, compatibility with
adjacent zoned uses, availability of public services and utilities, access, and
public need.
o The compatibility of agricultural and non-agricultural uses should be carefully
reviewed and where appropriate, buffers required.
o Rural-style residential-agricultural developments, such as new small-scale rural
communities or extensions of existing rural communities, shall be encouraged in
appropriate locations.
o The county shall encourage the development and maintenance of communities
meeting the needs of its residents in balance with the physical and social
environment.
o Agricultural land shall be used as one form of open space or green belt.
While the potential for agricultural uses may exist, the project site soils are
classified Kikoni Series (KXC). This soil consists of well-drained, very fine loams that
formed in volcanic ash. These soils are nearly level to moderately sloping. They are;
on the Waimea plains at an elevation ranging from 2,600 to 3,600 feet. In a
representative profile, the surface layer is very dark brown very fine sandy loam about
6 inches thick. The surface layer is dark brown and dark reddish-brown very fine
sandy and silt loam. The substratum is fragmental Aa lava. The surface layer is
neutral, and the subsoil is mildly alkaline. The surface is extremely stony in places.
Permeability is moderately rapid, runoff is slow and the erosion hazard is slight. Soils
within the subject property have been classified as "C" (Fair) for agricultural
productivity by the Land Study Bureau's Detailed Land Classification System. The
subject property is classified as "Prime" agricultural land by the ALISH system.

"Prime" agricultural lands have the soil quality, growing season and moisture supply
needed to produce high sustained yields of crops economically when treated and
managed according to modern farming methods. The requested FA-la zoning will
encourage agricultural activities or the presentation of the lands within the proposed
subdivision in a manner consistent with the "Low Density" designation by the General
Plan LUPAG Map. The Low Density Urban Development designation refers to single
family residential in character, ancillary community and public uses and convenience
type commercial uses.
In the implementation of these goals and policies and standards, the applicant
will complete its proposed project in compliance with all of the codes and standards
referenced above. Therefore, the proposed rezoning and development will complement
land uses within the community and neighborhood it is proposed to be located in.
The proposed subdivision of three lots would be compatible with the rural
character of the surrounding lands and provide opportunities for a mix of farm
residential, hobby or limited scale agricultural activities on lands that are well suited
for agricultural pursuits. These 1 acre lots would be compatible with the surrounding;
area. Surrounding parcels are zoned A-5a and A-la and State Land Use Agricultural
zoned district. Kamuela Haven, located to the west and adjacent to the subject
property is a residential subdivision with 7,500 square feet lot sizes. Nani Waimea
Subdivision located directly across Mamalahoa Highway is a residential subdivision
with 8,900 square feet lots. Lands to the east are zoned A-40a. Surrounding land uses
include various single-family residential and agricultural uses. The proposed 1 acre lot
size will also provide additional opportunities for residents who wish to pursue limited
agricultural activities, but are not able to commit to the financial or labor demands
placed on them by the larger 3-acre zoned parcels. Therefore, a favorable
recommendation of this change of zone request will be consistent with the surrounding
land use pattern already established within this area.
Primary access to the subject area is from the Mamalahoa Highway, on an
improved 60 foot wide right-of-way and a 20-foot wide paved roadway surface. The
State Department of Transportation has not expressed any concerns regarding the
traffic generated by the proposed subdivision and potential impacts to the Mamalahoa.
Highway, with the exception of complying with the minimum sight distance for
subdivision access road connection to Mamalahoa Highway and limiting direct access
to the highway from the individual subdivided lots. These restrictions and
requirements will be accessed and imposed at the time of subdivision review.

Water for the existing building is presently served by an existing 12-inch
waterline fronting the subject property. Wastewater generated by the proposed
development will be disposed of utilizing an individual wastewater disposal system for
each lot meeting the requirements of the Department of Health.
All other essential utilities and services are or will be made available to support
the proposed development.
Archaeological sites are not anticipated to be located within the subject property
due to former and current agricultural activities and homesite improvements. The
Department of Land and Natural Resources has indicated that the proposed subdivision
development will have "no effect" on historic sites. Should historical sites be located
within the subject property, the applicant will be required to immediately notify the
Planning Department.
Based on the above findings, approval of the Change of Zone request from
Agricultural-3 acres (A-3a) to Family Agricultural-1 acres (FA-la) zoned district would
result in an appropriate land use pattern that will further the public necessity and
convenience and the general welfare.
For your favorable consideration, an amendment to Section 25-8-11, the Lalamilo-Puukapu
Zone Map, of the County Zoning Code is transmitted.

CHANGE OF ZONE APPLICATION (REZ 91-30)
GENESIS K. BELL (FORMERLY MARY H. LINDSEY), has submitted an
amended application for a Change of Zone by changing the district classification from
Agricultural (A-3a) to Family Agricultural (FA-la), for approximately 3.00 acres of land.
Also requested is the withdrawal of the State Land Use Boundary Amendment from an
Agricultural to Rural District. The property is located in the south side of Mamalahoa
Highway across from the Nani Waimea Subdivision, Puukapu, Waimea, South Kohala,
Hawaii, TMK: 6-4-2:148.
GENERAL INFORMATION
1. Ownership: Genesis K. Bell, etal., are the owners of the subject property.
BACKGROUND INFORMATION
2. December 19, 1991: The applicant requested a continuance of the application. The
Department of Water Supply had indicated that the existing water system facilities were
not able to support the proposed subdivision.
3. March 29, 1993: Amendment to change of zone application which proposed a three
(3) lot subdivision rather than the original four (4) lots.
4. February 9, 1998: By letter, the applicant requested to amend the request to change
the zoning of the subject property to FA-la instead of RA-la. The applicant also
requested to withdraw the State Land Use Boundary Amendment. Also by letter dated
Febaruary 12, 1998, Mary Lindsey (mother and original applicant) authorized her son,
Genesis Bell, to be the applicant.
PROPOSED DEVELOPMENT
5. Request: The applicants are proposing a Change of Zone to change the district
classification from Agricultural (A-3a) to Family Agricultural (FA-la), for
approximately 3.00 acres of land to develop a 3 lot subdivision.

6. Objectives: "I am Genesis K. Bell son of Mary H, Lindsey who is the original
applicant to rezone the above property. She has sold this property to her three sons,
myself, Matthew K. Bell and Gerald K. Bell whom both are deceased. I wish to
subdivided this three acre parcel among my brother's families whom are presently
renting on Oahu. They wish to relocate and settle on the property when it is
subdivided.
"I wish to amend by request to Fa-la and to withdraw my State Land Use Boundary
Amendment. "
7. Supportive Information: The applicants have submitted the following in support of
the request: (See Exhibit A - Letter dated February 9 and 12, 1998 and Change of
Zone dated May 1, 1991.
STATE AND COUNTY PLANS
8. SLU: Agricultural.
9. General Plan Land Use Pattern Allocation Guide (LUPAG) Map: Low Density
Urban Development. The Low Density Urban Development designation refers to
single family residential in character, ancillary community and public uses and
convenience type commercial uses. This designation does not refer to density
limitations however, this designation generally has been at a density of 4 units per acre.
10. General Plan Consistency: Economic, Land Use elements goals, policies and courses
of action for South Kohala.
11. Hawaii State Plan Consistency: Economic objectives and policies.
12. Waimea Design Plan: The subject property is located outside of the Waimea Design
Plan.
10. County Zoning: The property is currently zoned Agricultural-3 acre (A-3a).
11. SMA: The property is not situated within the Special Management Area.
DESCRIPTION OF SUBJECT PROPERTY AND SURROUNDING AREA
13. Property: The subject property has a total area of 3.00 acres. The property is
rectangular-shaped with an existing single family dwelling.

14. Surrounding Zoning/Land Uses: Surrounding parcels are zoned A-5a and A-la and
within the State Land Use Agricultural zoned district. Kamuela Haven, located to the
west and adjacent to the subject property is a residential subdivision with 7,500 square
feet lot sizes. Nani Waimea Subdivision located directly across Mamalahoa Highway
is a residential subdivision with 8,900 square feet lots. Lands to east are zoned A-40a.
Surrounding land uses include various single-family residential and agricultural uses.
15. Soil Conservation Service Soil Survey Report: The Soil Survey Report classifies
soils within the project site Kikoni Series (KXC). This soil consists of well-drained,

16. Land Study Bureau's Detailed Land Classification System: Soils within the subject
property are classified as "C" (Fair) for agricultural productivity by the Land Study
Bureau.
17. Agricultural Lands of Importance to the State of Hawaii (ALISH) system: The
subject property is classified as "Prime" agricultural land. "Prime" agricultural lands
have the soil quality, growing season and moisture supply needed to produce high
sustained yields of crops economically when treated and managed according to modern
farming methods.
18. FIRM: The subject property is located outside the 500-year flood plain (Zone X).
19. Flora/Fauna: Natural vegetation occurring on the property consist of Bermuda grass,
hilo <_,rass, rattan and kikuyugrass. No separate studies were conduced, however
planning reports have not indicated the presence of any rare or endangered plant or
animal life in this area.

20. Archaeology: According to letter dated January 22, 1992 from the Department of
Land and Natural Resources State Historic Preservation Division, "We believe that this
specific parcel is not in the district (Waimea Agricultural Field System Historic
District) and is unlikely to contain significant historic sites. The proposed action
should have 'no effect' on such sites."
21. Surrounding Land: Lands to the north and east are zoned A-40a. The properties
along Mamalahoa Highway, directly across and southeast of the subject property are
zoned A-5a and A-3a. The properties located one mile east toward Honokaa are zoned
A-3a.
PUBLIC UTILITIES AND SERVICES
22. Roads: Access is off Mamalahoa Highway, a County of Hawaii roadway with a
60-foot wide right-of-way and a 20-foot wide paved roadway surface.
23. Water: Water is provided by an existing 12-inch waterline that fronts the subject
property.
24. Wastewater: According to the Department of Health, the property is situated within
the Critical Wastewater Disposal Area and therefore, the applicant would be required
to dispose wastewater into septic tank system.
25. Utilities: Electrical and telephone service are or will be made available to the
property.

I. How requested change of zone will be consistent with the goals,
policies and courses of action (if applicable) of the General
Plan.
A. One of the three goals of the Land Use Element of the
General Plan states that the County shall "Designate and
allocate land uses in appropriate proportion and mix in
keeping with the social, cultural and physical environment
of the County."
1. The current land use scheme of properties near the
subject property is an example of mixing land use and
lot sizes within a community in such a manner that it
does not conflict with the surrounding social, cultural
and physical environment.
a. Kamuela Haven, located to the west and adjacent to
the subject property, is a residential subdivision
with lot sizes slightly larger than 7,500 square
feet each.
1. The subject property is located only a short distance
from the urban center of Waimea where essential
services, employment opportunities, etc., are readily
available.
C. One of the G.P.'s Courses of Action states that the County
shall "Encourage the development of appropriately located
and serviced privately-owned and state-owned lands for
houselots."
1. The applicant is planning to subdivide the property
into four lots and transfer ownership of four of the
lots to her four children who are planning to build on
the lots. When this occurs, the homes they are
currently living in will become available to the
public, thereby increasing, albeit to a very small
degree, the housing market in the Waimea area.
II. other Reasons for Request
A. The primary reason for the change of zone request is; to
enable the applicant to subdivide the subject property into
four lots and to transfer ownership of four of the lots to

Drainage
1. All development generated runoff shall be disposed of on site and shall not be
directed toward any adjacent properties.
2. Applicant shall be informed that if drywells are included in the subject improvernents,
an Underground Injection Control (UIC) permit must be applied for from the Department
of Health, State of Hawaii.
3. All grading and grubbing activities shall comply with Chapter 10 of the Hawaii County
Code.
Roadways
4. Vehicular access to the individual lots should not be from Mamalahoa Highway. The
access road sight distance must meet the requirements of the Statewide Design
Manual.

5. In the interests of pedestrian and bicyclist safety, the applicant should improve the
Mamalahoa Highway shoulder along the property's frontage. Pavement transitions,
striping, drainage improvements, and relocation of utilities may be required.

existing ROW width should be dedicated to the County as per the General Plan.

We have reviewed the subject applications and have the following comments.
Water can be made available from an existing 12-inch waterline along the Mamalahoa
Highway fronting the property.
Pursuant to the Department's "Water Commitment Guidelines Policy," a copy of which
is being forwarded to the applicant. a water commitment may be issued. Based on
the two (2) additional units requested in the proposed three (3)-unit change of
zone, the required water commitment deposit is $300.00.
Remittance by the applicant of the $300.00 is requested as soon as possible so
that a water commitment may be formally issued. The commitment will be in writing
with specific conditions and effective dates stated. Please keep in mind that
this letter shall not be construed as a water commitment. In other words, unless
a water commitment is officially effected. water availability is subject to change
depending on the water situation.
For the applicant's information, should the subject applications be approved and a
subdivision application be executed with the Planning Department, approval will be
subject to the following requirements:

2. The requested zone change will not only complement but
also enhance this goal of the G.P. The request is to
rezone the property from Agricultural (A-3a) to
Residential and Agricultural (RA-1/2 acre) to enable
the applicant to subdivide the subject property into
four lots, with each lot measuring approximately
32,600 square feet in size.
A zone designation of Residential and Agricultural
would be very appropriate within a community which is
already comprised of a mix of residential and
agricultural lots.
B. One of the policies of the Land Use Element of the G.P.
states that the County shall "Zone urban- and rural-types
of uses in areas with ease of access to community services
and employment centers and with adequate utilities and
facilities."
1. The subject property is located only a short distance
