Arakaki, Chairman and Members of the County Council County of Hawaii 25 Aupuni Street Hilo, HI 96720 Dear Chairman Arakaki and Members: Change of Zone Application (REZ 85-23) Applicant: Stanley and Lorraine Hechinger Request: A-20a to A-5a Tax Mao Key: 9-4-3:58 The Planning Commission, after a duly held public hearing on April 17, 1998, voted to recommend for your approval the proposed legislative bill to change the district classification for approximately 20.37 acres of land from Agricultural (A-20a) to Agricultural (A-5a). The property is located on the northwest side of Kamaoa Road, approximately 3,000 feet northwest of the Mark Twain Estates and Discovery Harbor Subdivisions, Kiolakaa-Keaa Homesteads, Ka'u, Hawaii. The Commission concurs with the following Planning Director's reasons for recommending favorable consideration of the change of zone: In order to consider an area for any type of zoning designation, the applicable goals, policies and standards of the General Plan must be adequately addressed. It is only through such a comprehensive policy analysis approach that evaluations and decisions can be made to better time and stage developments to achieve growth determined by the General Plan and related planning documents. The implications of these evaluations and decisions must be also considered as they may have an impact on similar areas in the County. The Change of Zone Application from Agricultural-20 acres (A-20a) to Agricultural- 5 acre (A-5a) zoned district will conform to the following goals, policies and standards of the General Plan Land Use, Economic, and Agricultural Elements. Honorable James Y. Arakaki, Chairman and Members of the County Council Page 2 Land use is one of the principal focal points of public concern and policy. The Land Use Element provides the primary basis for direct control and guidance of publicly and privately owned resources. It is also intended to be used as a policy guide for the coordinated growth and development of all sectors of the County. It sets forth goals, policies, standards and courses of actioq to accommodate growth without congestion, to designate and preserve the lands needed for residential use, commercial and visitor services, industry, agriculture and open space, and to coordinate these uses with the County's service and circulation systems. The overall Land Use goals, policies and standards are set forth to physically plan the lands in the County in the best interest of the island's residents. These state the following: LAND USE o Designate and allocate land uses in appropriate proportions and mix and in keeping with the social, cultural and physical environments of the County. o Zoning request shall be reviewed with respect to General Plan designation, district goals, regional plans, State Land Use District, compatibility with adjacent zone uses, availability of public services and utilities, access, and public need. o The compatibility of agricultural and non-agricultural uses should be carefully reviewed and where appropriate, buffers required. o Rural-style residential-agricultural developments, such as new small-scale rural communities or extensions of existing rural communities, shall be encouraged in appropriate locations. O Protect and encourage the intensive utilization of the County's important agricultural lands. o The county shall encourage the development and maintenance of communities meeting the needs of its residents in balance with the physical and social environment. 0 Agricultural land shall be used as one form of open space or green belt. Arakaki, Chairman and Members of the County Council Page 3 ECONOMIC o Economic development and improvement shall be in balance with the physical and social environments of the island of Hawaii. o The County of Hawaii shall strive for diversity and stability in its economic system. o The County shall provide an economic environment which allows new, expanded, or improved economic opportunities that are compatible with the County's natural and social environment. The applicants originally submitted their application in 1985 in order to subdivide the 20.37 acre parcel into four 5.1 acre lots. The application was originally continued to allow the consultant to discuss the proposed recommendations with the applicants. The applicants have expressed their intent to continue with the original request. The Land Use Pattern Allocation Guide (LUPAG) Map component of the General Plan is a representation of the document's goals and policies to guide the coordinated growth and development of the County. It reflects a graphic depiction of the physical relationship among the various land uses. The LUPAG Map establishes the basic urban and non-urban form for areas within the County. The subject property is designated Extensive Agriculture. Therefore, it is determined that the request is consistent with designation depicted on the LUPAG Map for this area of Kau. While the potential for intensive and/or extensive agricultural uses may exist, the project site is comprised of soils classified by the U.S. Department of Agriculture, Soil Conservation Service, as Punaluu extremely rocky peat (rPYD) which consists of well-drained, thin organic soils over pahoehoe lava bedrock. The surface layer is black peat about 4 inches thick. The peat is rapidly permeable. The pahoehoe lava is very slowly permeable, although water moves rapidly through the cracks. Runoff is slow., and the erosion hazard is slight. The elevation of the property is about 1,350 feet above sea level and has a slope of 6 to 20 percent. These soils are used for pasture. These soils are used for pasture. Soils within the subject property have been classified as "D" (Poor) for agricultural productivity by the Land Study Bureau's Detailed Land Classification System. Finally, soils within the subject property are "Unclassified" by the ALISH system. The property is designated Zone X, an area of minimal flooding. Honorable James Y. Arakaki, Chairman and Members of the County Council Page 4 Surrounding parcels are zoned A-20a and State Land Use Agricultural zoned district. On June 9, 1994 one parcel along the north side of Mamalahoa Highway was rezoned from A-20 to A-3a. Surrounding land uses include various single-family residential and agricultural uses. The property is located approximately 3,000 feet northwest of the Mark Twain subdivision zoned A-la with 20,000 square foot lots and Discovery Harbor subdivision zoned A-la with 14,000 square foot lots. Therefore, a favorable recommendation of this change of zone request will be consistent with the surrounding land use pattern already established within this portion of Kau. Access to the site is provided by Kamaoa Road, a two-lane County roadway, which has right-of-way widths that vary between 25 to 40 feet with a 16 to 18-foot wide pavement. The Department of Public Works has recommended that Kamaoa Road be paved to a width of 20 feet. At the time the applicant initially applied for the change of zone, Kamaoa Road had a pavement width of 10 feet. The road was subsequently widened by the Department of Public Works to a width of 16 feet. It is not recommended that the applicant be further responsible for widening Kamaoa Road, therefore, a condition is not included regarding this matter. Water is presently available for the proposed subdivision development and the! applicants have paid their water commitments. However, the Department of Water Supply has stated that should the water commitment expire, water will no longer be available to the subject property. All other essential utilities and services are or will be made available to support the proposed development. Based on the above findings, approval of the Change of Zone request from Agricultural-20 acres (A-20a) to Agricultural-5 acres (A-5a) zoned district would result in an appropriate land use pattern that will further the public necessity and convenience and the general welfare. For your favorable consideration, an amendment to Section 25-8-28, the Ka'u District Zone Map, of the County Zoning Code is transmitted. Honorable James Y. AND LORRAINE H. HECHINGER CHANGE OF ZONE APPLICATION (REZ 85-23) STANLEY L. AND LORRAINE H. HECHINGER, have submitted an application for Change of Zone by changing the district classification from Agricultural (A-20a) to Agricultural (A-5a), for approximately 20.37 acres of land. The property is located on the northwest side of Kamoa Road, approximately 3,000 feet northwest of the Mark Twain and Discovery Harbor Subdivisions, Kiolakaa-Keaa Homesteads, Ka'u, Hawaii TMK: 9-4-3:58. GENERAL INFORMATION 1. Ownership: Stanley and Lorraine Hechinger are the owners of the subject property. BACKGROUND INFORMATION 2. Original Submittal: The application was originally submitted in April 1985. The Planning Director issued a favorable recommendation with conditions. The public hearing held on December 2, 1985 was continued to allow the consultant an opportunity to confer with the applicant on the required conditions. In particular, a condition would have been included, that would have required the applicant to pave Kamaoa Road to a width of 20 feet. By letter dated January 29, 1998, the applicant confirmed their intent to continue with the application. 3. Subsequent Development: Subsequent to the first public hearing, Kamaoa Road has been paved by the Department of Public Works to a width of 16 feet. Numerous correspondences have occurred between the applicant, Planning Department and Department of Public Works, and are attached accordingly. PROPOSED DEVELOPMENT 4. Request: The applicants intend to subdivide the 20.37 acre parcel into four 5.1 acre lots. 5. Objectives: "We feel that there is a need for Agricultural parcels of 5 acres for family oriented Supplemental Income endeavors in Macadamia or Avocado Orchards, ATTACH. C-829 (B-238) specialty nursery or hot house products. 6. "The property is not presently in Agricultural use; but is suited for more Intensive Land Use than the present suited Designation, as set forth, in the County General Plan. 7. "There are only a limited number of 5 acre parcels located in the Waiohinu area. The acquisition cost of the larger parcels take it out of reach for the average purchaser. & "The property is readily accessible and is suitable for a more intensive agricultural use, with no topographical limitations on the subject parcel." 9. Supportive Information: The applicants have submitted the following in support of the request: (See Exhibit A - Change of Zone Application and letters dated January 29, 1998, January 25, 1998 and attachments, August 21, 1993, February 7, 1990 and attachments and March 10, 1986). General Plan Consistency: Economic, Housing, Land Use elements goals, policies and courses of action for Kau. 13. Hawaii State Plan Consistency: Economic and Housing objectives and policies. 14. County Zoning: The property is currently zoned Agricultural-20 acre (A-20a). 15. SMA: The property is not situated within the Special Management Area. DESCRIPTION OF SUBJECT PROPERTY AND SURROUNDING AREA 16. Property: The subject property has a total area of 20.37 acres. The property is rectangular shaped. The property is vacant of any uses. 17. Surrounding Zoning/Land Uses: The adjoining parcels are zoned A-20a and classified within the State Land Use Agricultural zoned district. FIRM: The subject property is located within Zone X, an area of minimal tloodin2,. 19. Agricultural Lands of Importance to the State of Hawaii (ALISH) System: The property is "Unclassified". 20. U.S. Soil Survey: The soils are classified as Punaluu extremely rocky peat (rPYD) which consists of well-drained, thin organic soils over pahoehoe lava bedrock. Flora and Fauna: The natural vegetation occurring on the property consists of koa haole, Christmas berry, guineagrass, natal redtop and sand bur. 23. Archaeology: An archaeological study was not conducted. However, the applicant would be required to cease work should any unidentified sites or remains be found. PUBLIC UTILITIES AND SERVICES 24. Access: Access to the project site is off Kamoa Road which has right-of-way widths that vary between 25 to 40 feet with a 16 to 18-foot wide pavement. At the submittal of the application, back in 1985, the pavement width was approximately 10 feet. 25. Water: Water is available to the property. Water commitments have been paid, however, according to the Department of Water Supply, should the water commitment expire, existing water facilities cannot support the proposed subdivision. 26. Utilities: Electrical and telephone service are or will be made available to the property. -3- AGENCIES' COMMENTS 27. We have four water commitments. The only objection to our Zone change was from Department of Public Works (DPW) wanting us to improve Kamaoa Road in front of our property, i.e., widen it to 20 feet, etc., at prohibitable expense to us. Subsequently, it was learned that gas tax funds were to be incre- mentally available to improve Kamaoa Road (COPY #1). It has been our understanding that the DPW conditions would be removed when the road improvement by the County was complete. Last May I wrote to DPW (COPY #2). There was no response until after I made two follow-up calls; the 1st to Stanley Nakasone. The 2nd was to Casey Yanagihara in July, during which I learned that a relief on the imposed requirments could be granted with a variance by the Planning Department. Then the letter from Galen. Kuba was received (COPY #3). After all this time of waiting for the County to improve the road, it is most frustrating, to say the least, to now learn that the work done by it is not as good as to what would be required of us. The funds for the proposed improvements to Kamaoa Road is from the fuel tax. The ordinance allocates funds to this road as follows: Inc. II $16,200 7/89 - 6/91 Inc. III $196,200 7/91 - 6/93 Inc. IV $196,200 7/93 - 6/95 Inc. V .$196,200 7/95 - 6/97 The total amount of funds to make improvements to Kamaoa Road is $604,800, which is available by June 30, 1997. We will expend these funds for land acquisition and construction, but we do not know at this time how far the funds will take us. We will start construction from the Mamalahoa Highway to the South Point Road. We feel, as we did in 1985, that the zone change should not be granted until, and if, the improvements reach this property. If the Planning Dept. wants to grant approval before an adequate infrastructure is in place, then we feel that the owner could at least pave his frontage. Thank you for your letter of July 30, 1993. It reminded me that, although we received a reply from the Water Dept., there has been no response from Public Works. Also, that eight years really has elapsed (through no fault of ours), and I haven't even had any fun doing this. As mentioned in my previous letter to Mr. Yanabu, Kamaoa road is in the process of being fully improved by the County with designated gas tax revenues. In view of this we have hoped that the condition imposed by Public Works would be removed. All efforts on our part, including a trip to Hilo by Lorraine last year, have been to no avail. Koi, Chairman Pro Tem Dear Barbara Koi: I received the copy of your December hearing regarding the division of our 20 acres in Kau, and would like to thank you and the Planning Commission for your consideration and the approval of the division of the property. Due to the condition imposed by the Dept, of Public works, however, there is now some hesitation as to the feasibility of our continuing with the division. We had contemplated others to be able to purchase five acre parcels priced reason- ably enough for an economical use of the land. However, the expense involved to comply with the recommendation of the Dept. of Public Works would prohibit this. Admittedly, Kamaoa Road may need sane improvement. Yet doing so for such a small portion does not appear to be a solution to the problems cited by the Public works Dept. Perhaps those aims could be accomplished with some type of bond issue providing for improvement of all of Kamaoa Road, the cost of which being borne by all fronting owners. This would seem to be an amicable solution to the problem. Alternatively, since the State is the owner of the road, perhaps the State should do the improving thereof. with the hopeful thought that the Public Works Dept. will be agreeable to the alternatives and eliminate conditions "C" and "E", we would like to complete the re-zoning and proceed with the subdivision of the property. Hechinger, are the fee simple owners of Lot 3, portion of Grant 2650 to Kauhiahiwa, situate at Kiolakaa, Ka'u, Hawaii, containing an areaof 20.37 Acres in TMK 9-4-03: Parcel 58. The primary reason for requesting a change of zone is to create aid make available parcels of agricultural zoned lands containing 5 Acres. We note that the available parcels average 10 to 30 Acres in size, with all land parcels in TMK 9-4-02, 9-4-03 and 9-4-04 presently zoned A-20a. We feel that there is a need for Agricultural parcels of 5 Acres for family oriented Supplemental Income endeavors in Macadamia or Avocado Orchards, specialty nursery or hot-house products. II. LAND USE CLASSIFICATION The property is presently in Agricultural District Classification by the State Land Use Commission. III. COUNTY GENERAL PLAN DESIGNATION The General Plan Land Use Pattern Allocation Guide (LUPAG) Map for Ka'u District desinates the property for Extensive Agricultural Use (as opposed to Intensive Use). This Use designation implies the utilization of large areas of land with the minimum of labor and equipment. IV. COUNTY COMPREHENSIVE ZONING ORDINANCE The Hawaii County Comprehensive Zoning ordinance designation for Lot 3 is A-20a. A-20a zoning appears to dominate Agricultural land designation in the Waiohinu area, therefore, we are requesting that consideration be given to permitting zoning of agricultural parcels of less than 20 acres. V. PROPERTY A. LOCATION The subject site is located approximately 1.2 miles west of Waiohinu Village, on the northerly side of the Eamaoa Road. The immediate area consists of owner occupied dwellings sit- uated on large sized parcels of land. The basic agricultural use is Orchard or Pasture with some hot- houses. The existing access from Waiohinu is over a paved roadway. All the necessary public utilities such as water, electricity and telephone are already in place and are available. B. AGRICULTURAL USE The property is not presently in Agricul- tural use; but is suited for more Intensive Land Use than the present suited Designation, as set forth, in the County General Plan. C. ELEVATION The property is 1350 feet above sea level. D. DRAINAGE There appears to be minimal drainage problems. E. RAINFALL The property averages approximately 60 inches per year. F. SOIL DESCRIPTION: The U.S. Department of Agriculture Soil Conservation Service Survey (1973) has classified the soil on the property as rPYD "Punaluu extremely rocky peaLt 6-208 slopes. Punaluu series consists of well-drained, thin organic soils over pahoehoe lava bedrock, These soils' are gently sloping to moderately steep. The natural vegetation consists of koa haole, christmas berry, guinea grass, etc,. Punaluu Soils are basically used for pasture. G. GENERAL SOIL MAP: Kekake-Keei-Kiloa association: Very shallow, gently sloping to steep, well drained organic soils over Aa or Pahoehoe lava, on uplands. H. LAND CLASSIFICATION: Land Study Bureau's overall Master pro- ductivity soil rating for Agricultural use is Class C. I. TRAFFIC IMPACT: There will be only minimal increase in vehicular traffic. J. AVAILABILITY OF PUBLIC SERVICES AND FACILITIES: 1. Schools: Naalehu Elementary and Intermediate Schools are located approximately 3.5 miles from the property. A High School is located at Pahala approximately 20 miles from the property. 2. Sewers: Cesspools are proposed. 3. Water: A County Water System is located within the Kamaoa Road. 4. Sanitation: Solid Waste facilities are located in Waiohinu. 5. Electricity: 6. Gas: ALL UTILITIES ARE AVAILABLE. 7. Telephone: 8. PROPOSED DEVELOPMENT PLAN FOR PROPERTY This application is to obtain approval from the County of Hawaii to create, and make available to others, four(4) five(5) acre agricultural parcels of land near Waiohinu Hawaii. (2) There is no ev: ace of Archeological Sits on the property. There are ao endangered flora or fauna on the property. VII. ENVIRONMENTAL DATA 1. The Rezoning of the Property will not have a significant impact upon the area and its neighborhood. 2. No serious erosion or flood hazards are anticipated. 3. There is no evidence of natural hazards that have occurred on the property. VIII MARKET NEED AND DEMAND There are only a limited number of 5 acre parcels located in the Waiohinu area. The acquisition cost of the larger parcels takes it out of reach for the average purchaser. IX JUSTIFICATION FOR PROPOSED REZO'1ING CLASSIFICATION The property is readily accessible and is suitable for a more intensive agricultural use, with no topographical limitations on the subject parcel. "(e) Permissible Modifications. Vertical clearances or widths required by this section may be increased when, in the opinion of the chief, vertical clearances or widths are not adequate to provide fire apparatus access. "(f) Surface. Fire apparatus access roads shall be designed and maintained to support the imposed loads of fire apparatus and shall be provided with a surface so as to provide all- weather driving capabilities." (20 tons) "(g) Turning Radius. The turning radius of a fire apparatus access road shall be as approved by the chief." (45 feet) "(h) Turnarounds. All dead-end fire apparatus access roads in excess of 150 feet in length shall be provided with approved provisions for the turning around of fire apparatus:. When a bridge is required to be used as access under this section, it shall be constructed and maintained in accordance with the applicable sections of the Building Code and using designed live loading sufficient to carry the imposed loads of fire apparatus. 11(j) Grade. The gradient for a fire apparatus access road shall not exceed the maximum approved by the chief." (1.5$) "(k) Obstruction. The required width of any fire apparatus access road shall not be obstructed in any manner, including parking of vehicles. Minimum required widths and clearances established under this section shall be maintained at all times. 11(1) Signs. When required by the fire chief, approved signs or other approved notices shall be provided and maintained for fire apparatus access roads to identify such roads and prohibit the obstruction thereof or both." "INSTALLATION AND MAINTENANCE OF FIRE-PROTECTION, LIFE-SAFETY SYSTEMS AND APPLIANCES "Installation "Sec. 10.301. (a) Type Required. The chief shall designate the type and number of fire appliances to be installed and maintained in and upon all buildings and premises in the jurisdiction other than private dwellings. This shall be done according to the relative severity of probable fire, including the rapidity with which it may spread. Such appliances shall be of a type suitable for the probable class of fire associated with such building or premises and shall have approval of the chief. "(b) Special Hazards. When required by the chief, hydrant locations shall be identified by the installation of reflective markers. V(e) Timing of Installation. There has been no response from your department. As a result of this delay, aside from other factors, an additional payment was required for an extension of our water commitment in May of this year. After owning the property for 20 years, we have felt that this division of the land could certainly put the land into a more pro- ductive state, in addition to providing more revenue to the County due to the smaller parcels. As for Kamaoa Road, three additional users of same would not appear to be a major burden to the traffic flow thereon. Hechinger, are the fee simple owners of Lot 3, portion of Grant 2650 to Kauhiahiwa, situate at Kiolakaa, Ka'u, Hawaii, containing an areaof 20.37 Acres in TMK 9-4-03: Parcel 58. The primary reason for requesting a change of zone is to create aid make available parcels of agricultural zoned lands containing 5 Acres. We note that the available parcels average 10 to 30 Acres in size, with all land parcels in TMK 9-4-02, 9-4-03 and 9-4-04 presently zoned A-20a. We feel that there is a need for Agricultural parcels of 5 Acres for family oriented Supplemental Income endeavors in Macadamia or Avocado Orchards, specialty nursery or hot-house products. II. LAND USE CLASSIFICATION The property is presently in Agricultural District Classification by the State Land Use Commission. III. COUNTY GENERAL PLAN DESIGNATION The General Plan Land Use Pattern Allocation Guide (LUPAG) Map for Ka'u District desinates the property for Extensive Agricultural Use (as opposed to Intensive Use). This Use designation implies the utilization of large areas of land with the minimum of labor and equipment. IV. COUNTY COMPREHENSIVE ZONING ORDINANCE The Hawaii County Comprehensive Zoning ordinance designation for Lot 3 is A-20a. A-20a zoning appears to dominate Agricultural land designation in the Waiohinu area, therefore, we are requesting that consideration be given to permitting zoning of agricultural parcels of less than 20 acres. V.' PROPERTY A. LOCATION The subject site is located approximately 1.2 miles west of Waiohinu Village, on the northerly side of the Kamaoa Road. The immediate area consists of owner occupied dwellings sit- uated on large sized parcels of land. The basic agricultural use is Orchard or Pasture with some hot- houses. The existing access from Waiohinu is over a paved roadway. All the necessary public utilities such as water, electricity and telephone are already in place and are available. B. AGRICULTURAL USE The property is not presently in Agricul- tural use; but is suited for more Intensive Land Use than the present suited Designation, as set forth, in the County General Plan. C. ELEVATION The property is 1350 feet above sea level. D. DRAINAGE There appears to be minimal drainage problems. E. RAINFALL The property averages approximately 60 inches per year. F. SOIL DESCRIPTION: The U.S. Department of Agriculture Soil Conservation Service Survey (1973) has classified the soil on the property as rPYD "Punaluu extremely rocky peat 6-208 slopes. Punaluu series consists of well-drained, thin organic soils over pahoehoe lava bedrock, These soils are gently sloping to moderately steep. The natural vegetation consists of koa haole, christmas berry, guinea grass, etc,. Punaluu Soils are basically used for pasture. G. GENERAL SOIL MAP: Kekake-Keei-Kilos association: Very shallow, gently sloping to steep, well drained organic soils over Aa or Pahoehoe lava, on uplands. H. LAND CLASSIFICATION: Land Study Bureau's overall Master pro- ductivity soil rating for Agricultural use is Class C. I. TRAFFIC IMPACT: There will be only minimal increase in vehicular traffic. J. AVAILABILITY OF PUBLIC SERVICES AND FACILITIES: 1. Schools: Naalehu Elementary and Intermediate Schools are located approximately 3.5 miles from the property. Mr. Hechinger has asked that I respond. The request from Public Works that the applicant be required to improve Kamaoa Road for the frontage of his property has been the issue that has prevented the rezoning of this property for the past thirteen years. The applicant was led to believe by DPW's comments dated February 26, 1990, that the County was improving Kamaoa Road using the fuel tax revenues. They state "that the zone change should not be granted until, and if, the improvements reach this property " After six years Mr. Hechinger inquired if the improvements had in fact reached his propertv. He told b , .h ao nt .b th h.a . ch°d h:, w.,t . . the w... u u prep , provements made by the County to their road did not meet "County dedicable standards". He was still to be required to improve the roadway. In this letter Galen Kuba states, "We suggest you apply for a variance, or an appeal with the Planning Department." There is no variance or appeal process available while requesting a change of zone. We do how- ever make a request to the Planning Department, Planning Commission and the Hawaii County Council to review this issue when placing conditions on this change of zone request. The existing 3 mile long roadway was paved to a width of 16 to 18 feet by the County using the fuel tax revenues. The request to improve the 900 foot frontage of the subject property to 20 feet in this rural area seems to be an unreasonable expense for the applicant and will do very little to improve traffic flow on this roadway. The applicant believes if the added two feet is critical to public safety and welfare the County would have improved the roadway to this standard when they made their improvements.
