REPORT OF THE <br />COMMITTEE ON FINANCF, <br />DA"I'E: July 22, 2004 Re: Comm. No. 647/Bill No. 280 <br />PLACFi: Council Chambers <br />TIMIi: 10:10 a.m. <br />Council Chair and Members <br />1{awai'i County Council <br />Hilo, Hawaii 96720 <br />Your Committee on Finance, to which was referred Bill No. 280, reports as follows: <br />Bill No. 280, transmitted by Council Vice Chair J. Curtis Tyler IIh via Communication No. 647, <br />dated Junc 2.2004, amends the Hawaii County Code 1983 (1995 Edition) by adding a new <br />chapter relating to business improvement districts. <br />This Ordinance enables die establishment and creation of Business Improvement Districts (BID), <br />which will provide an alternate method of financing supplemental services and improvements <br />when public funds are not available. <br />Originally heard on June 14, 2004, this measure was deferred pending additional information. <br />Communication No. 647.8 from Legislative Auditor Constance R. Kiriu, dated July 15, 200. <br />provided an explanation on Bill No. 280, relating to the reason a new chapter for B1Ds was <br />established; the major differences between BIDS and other financing tools; the responsible party <br />for determining the amount of money needed for the supplemental services; frequency of <br />assessment collection; fairness in number of owners who initiate proceedings and the number <br />who can stop die proceedings; contiguity questions; board enforcement powers; and the required <br />sale by the County if land is donated. <br />Ms. Kiriu also made recommendations tcorrect minor clerical errors and to delete the <br />requirements that the County sell donated lands. <br />A communication from Deputy Corporation Counsel Bobby .lean Leithead-"Todd, dated <br />,luly 22. 2004, responded to Your Committee questions by confirming that the County may <br />require a board or association to manage a BID; that the board or association does not have to <br />comply with the procurement code or Civil Service laws; and that nothing in the procurement <br />code or ethics laws or ndes prohibits a Council Member for serving on the board or association. <br />Your Committee requested the Legislative Auditor's Office and the Office of the Corporation <br />Counsel look at the lormatting of the general provisions in this measure to incorporate with <br />Draft 2 amendments. <br />FC REPORT NO. 2R1 <br />
