Hussey <br /> Tax Map Key: 5-9-7:7 <br /> <br /> We are writing to provide additional information on our request to extend the time of the <br /> zoning. <br /> <br /> Change of Zone Ordinance No. 90-800 (REZ 655) included the following two conditions: <br /> (B) Subdivision plans shall be submitted to the Planning Department within one <br /> year from the effective date of the change of zone. Final subdivision approval shall be <br /> secured within one year from the date of receipt of tentative subdivision approval... <br /> (K) ...5) if the applicant should require an additional extension of time, the <br /> Planning Director shall submit the applicant's request to the County Council for <br /> appropriate action... <br /> <br /> As expressed in a March 18, 1996, letter to us from the Planning Department, "Final <br /> Subdivision Approval shall hereby be secured on or by February 10, 1997." <br /> As advised in a March 7, 1997, letter from the Planning Department, we are requesting <br /> an extension of time to perform the conditions of our ordinance. <br /> The Hawaii County Zoning Code, Chapter 25, Section 25-2-44 requires a written <br /> request, a filing fee of $250, and two notifications of surrounding neighbors, for a time <br /> extension request. <br /> <br /> For an update of the status of the subdivision , we are attaching a copy of our annual <br /> progress report, which is required by Condition J of the ordinance.
