Hawaii 96720 <br /> <br /> <br /> <br /> RE: Resolution 685-08 <br /> Proposed Charter Amendment to Amend Article XIII, Section 13-11 Relating to Penalties <br /> <br /> <br /> Dear Chair Hoffmann and Council Members: <br /> <br /> Resolution 685-08 directs the County Clerk to place the Charter amendment proposed by <br /> 0i-dniallce No. 08-82 on the 2008 General Election ballot for approval by the voters of the <br /> County, "Phis includes submission of ballot language to the state chief election officer prior to <br /> 4:30 p.m._ September 5, 2008, pursuant to section 11-119(b) Hawaii Revised Statutes. While it <br /> is the responsibility of the County Clerk to draft ballot questions, I am requesting that this <br /> i•.c;nununication be placed on the appropriate agenda with Resolution 685-08, so that council <br /> members will be able to provide comment on my proposed ballot language, which is as <br /> follows: <br /> <br /> <br /> PROPOSAL 4. Fines and penalties. Should County Charter section 13-11, Penalties, be <br /> changed to double the maximum fine for criminal penalties and make distinctions <br /> between civil and criminal penalties for violations of the Charter, ordinances, and rules <br /> and regulations? Date lUl~ 19 2D'D <br /> PRESENT PROVISION: Presently, section 13-11, Penalties, of the Hawaii County <br /> Charter allows the County Council to establish by ordinance a maximum fine of one <br /> thousand dollars for criminal and civil violations of ordinances and regulations.
