Transfer of Haim Mill Road: Resolution 290-98

Gentlemen:

The following is submitted with respect to Resolution No. 290-98 regarding the
transfer of ownership of the Hain Mill Road to the County of Hawaii. A portion of Haina Mill
Road is presently under the management and control of Hamakua Sugar Company, which is in
Chapter 11 bankruptcy. As Trustee of the bankruptcy estate, I am in the process of winding up
the estate and disposing of all remaining assets.

The Chapter 11 bankruptcy estate of Hamakua Sugar Company, Inc. is not in a
position to continue its ownership of the road, nor to improve or maintain it. The Haina Mill
Road currently serves as access to the subdivisions of the Haina Camp, the four house lots on
= adjacent Spencer Road, and the Haina Ball Park. The road is also used for waterline casement
, A,,;V`Purposcs by the County Water Commission. The County's acceptance of the road would be
rte most beneficial to the residents of the Haina Camp community by continuing to provide roadway
access and utility services to the Haina Camp area.
" It is my recommendation that the County accept the ownership of the road "as is",
in order to continue and to promote access for the various properties that already are served by
the road, as well as the County interests.

Comm.
