<br /> <br /> <br /> <br /> <br /> REPORT OF THE <br /> COMMITTEE ON PLANNING <br /> <br /> <br /> DATE: May 19, 2008 Re: Comm. 1191/Bill 292 <br /> PLACE: Sheraton Keauhou Bay Resort and Spa <br /> 78-128 Ehukai Street <br /> Kailua-Kona, Hawaii <br /> TIME: 2:30 p.m. <br /> <br /> Council Chair and Members <br /> Hawaii County Council <br /> Hilo, Hawaii 96720 <br /> <br /> Your Committee on Planning, to which was referred Bill 292, reports as follows: <br /> <br /> Bill 292, transmitted via Communication 1191 from Mayor Harry Kim, dated <br /> April 21, 2008, presents an amendment to Change of Zone Ordinance No. 96-36 <br /> (Condition C) by HILO HILLSIDE CORPORATION, which rezoned 153.479 <br /> acres of land from an Agricultural 20-acre (A-20-a), Agricultural 10-acre (A- I Oa) and <br /> Agricultural 3-acre (A-3a) to a Residential and Agricultural I-acre (RA-1a) zoned <br /> district. <br /> <br /> The property is located along the south side of the Puainako Street Extension, southwest <br /> of the Sunrise Estates Subdivision, Increment I, Kukuau I", South Hilo, Hawaii, <br /> TMK: 2-4-8: portion 14 and 26. <br /> <br /> The effective date of Ordinance No. 93-36 was April 23, 1993. The applicant is <br /> requesting additional time to comply with Condition C of the ordinance, which required <br /> that Final Subdivision Approval be secured within two years from receipt of Tentative <br /> Subdivision Approval. March 23, 1995 was the effective date of the revised Tentative <br /> Subdivision Approval. <br /> <br /> The applicant states the request for additional time to comply with Condition C is due to <br /> the County's realignment, acquisition and construction of the Puainako Street Extension <br /> through the property, requiring revision of the final plat map conforming to the new road <br /> right-of-way. As the result of discussions in 2004 between the applicant and State and <br /> County officials regarding condemnation of approximately three acres fronting the <br /> drainage easement along the new Puainako Street Extension, applicant agreed to the <br /> condemnation. <br /> <br /> A two-year administrative time extension was granted by the Planning Director from <br /> February 18, 2004 until February 16, 2006 to comply with Condition C. On <br /> January 23, 2008, the applicant submitted the current request for a five-year extension of <br /> time to comply with condition C. <br /> <br /> <br /> <br /> PC Report No. 86 <br />
