• <br />County of Hawai `i <br />PLANNING COMMISSION <br />Aupuni Center • 101 Pauahi Street, Suite 3 • Hilo, Hawaii 96720 <br />Phone (808) 961-8288 • Fax (808) 961-8742 <br />June 12, 2008 <br />Pete Hoffmann, Chairman <br />and Members of the County Council <br />County of Hawaii <br />333 Kilauea Avenue, 2"d Floor <br />Hilo, HI 96720 <br />Dear Chairman Hoffmann and Council Members: <br />State Land Use Boundary Amendment Application (SLU 07-000018) <br />Applicant: Kona Heights, LLC <br />Request: Agricultural to Urban <br />Tax Map Key: 7-7-8:121 <br />The Planning Commission, after a duly held public hearing on May 22, 2008, voted to <br />recommend for your approval the proposed legislative bill to change the State Land Use district <br />from Agricultural to Urban for 11.054 acres of land located at the south end of Naniloa Street <br />and adjacent to the White Sands Beach Estates and Keauhou View Estates Subdivisions, <br />Kapalaalaea, North Kona, Hawaii. There were concurrent applications for a change of zone to <br />change the district classification from an Agricultural — 5 acre (A -5a) to a Single Family <br />Residential — 7,500 square foot (RS -7.5) district and a Special Management Area (SMA) Use <br />Permit to allow the development of a 65 -lot single family residential subdivision and related <br />improvements. The Commission voted to continue both of these applications to its next Kona <br />meeting on June 20, 2008. <br />The Commission concurs with the following findings as recommended by the Planning Director: <br />The approval of the reclassification from the State Land Use Agricultural to the <br />Urban District will not be violative of Section 205-2, Chapter 205, Hawaii Revised <br />Statutes, nor will it be inconsistent with the Land Use Commission Rules and the County <br />General Plan. According to the Land Use Commission Rules, one of the standards for <br />considering an area for urban reclassification states that "In determining urban growth for <br />the next ten years, or in amending the boundary, land contiguous with existing urban <br />areas shall be given more consideration than non-contiguous land, and particularly when <br />indicated for future urban use on state or county general plans."
