5. July 15, 1998 -Subdivision Application (SUB No. 98-0084) for an 8-lot subdivision <br /> was submitted to the Planning Department and its status is pending review by the <br /> applicable agencies. Deadline for Tentative Subdivision Approval is August 29, 199E~. <br /> 6. Conditions B, C, D and E of Ordinance No. 90-85 states the following: <br /> "(B) The required water commitment payment shall be submitted to the Department <br /> of Water Supply in accordance with its 'Water Commitment Guidelines Policy' <br /> within ninety days from the effective date of the change of zone; <br /> "(C) Consolidation/resubdivision plans shall be submitted within one year from the <br /> effective date of the change of zone. Final subdivision approval shall be secured <br /> within one year from the date of receipt of tentative subdivision approval; <br /> "(D) Final Plan Approval for the commercial development shall be secured from the <br /> Planning Department within one year from the date of final subdivision <br /> approval. To assure adequate time for plan approval review and in accordanc<; <br /> with Chapter 25-244 (Zoning Code), Hawaii County Code, as amended, plans <br /> shall be submitted a minimum of forty-five days prior to the date by which plan <br /> approval must be secured; <br /> "(E) Construction of the commercial development shall commence (building permits) <br /> within one year from the date of receipt of Final Plan Approval provided, <br /> however, that Condition H has been satisfied. The development shall be <br /> completed (certificates of occupancy) within two years thereafter." <br /> <br /> PROPOSED MENDMI+'NTS <br /> 7. Request: In a letter dated June 19, 1998, the applicant submitted the requested <br /> amendments to Conditions B and C, and deletion Conditions D and E of Ordinance <br /> No. 90-85. (See Exbibit B -Submittal dated June 19, 1998) <br /> 8. Objectives: The applicant is requesting certain time extensions, as well as the <br /> modification and/or deletion of certain conditions which are no longer applicable. An <br /> amendment to Condition B will extend the time performance in which the required <br /> water commitment payment shall be submitted to the Department of Water Supply in <br /> accordance with its "Water Commitment Guidelines Policy" within ninety (90) days <br /> from the effective date of the amended change of zone.
