The amendment to the condition relates to time extension for agricultural activity <br /> performance requirement. The property is located in the Kohala Estate Subdivision along the <br /> northwest side of Ala Kahua Drive approximately one mile mauka of the Akoni Pule <br /> Highway-Ala Kahua Drive intersection, Kahua, North Kohala, Hawaii. <br /> <br /> The Commission concurs with the following Planning Director's reasons for recommending <br /> favorable consideration of the request: <br /> <br /> The purpose of this request is for an additional extension of time to comply with <br /> the agricultural activity performance requirements of Ordinance No. 90-139 to ensure <br /> that the applicant is not in violation with the time conditions. <br /> <br /> The inability of the petitioner to comply with the requirements of Condition C <br /> of Change of Zone Ordinance No. 90-139 is a result of conditions which could not <br /> have been foreseen or are beyond the control of the applicant. <br />
