Section 20-54. Summons or citation for violation. <br />A police officer shall use a form of summons or citation provided by the Countv in citing_a <br />violator of any_provision of this article. <br />Section 20-55. Penalty. <br />(a) Any person who violates the provisions of this article shall, upon conviction, be sentenced to <br />pay a fine of not more than $1,000 and/or not more than 200 hours of community service for <br />each offense and shall be required to remove their plastic bags or shall be liable for the costs <br />of removing the plastic bags. <br />bbl Each day of violation shall constitute a separate offense. <br />(c) Fines collected pursuant to this chapter shall be deposited into the public access, open space, <br />and natural resources fund, as authorized by section 2-214(b)(3), which permits monies to be <br />deposited to the fund from "any source of revenue dedicated by the Hawaii County Charter <br />or the Hawaii Countv Code for the purposes of this article." " <br />SECTION 3. Severability. If any provision of this ordinance, or the application thereof to any <br />person or circumstance, is held invalid, such invalidity shall not affect other provisions or <br />applications of the ordinance which can be given effect without the invalid provision or application, <br />and to this end, the provisions of this ordinance are declared to be severable. <br />SECTION 4. New material is underscored. In printing this ordinance, the underscoring need <br />not be included. <br />SECTION 5.
