In anticipation of the Finance Committee's discussion on Resolution No. 310-98, we
request information on the following:
• Did the Hawai'i County Police Department, acting either alone or in conjunction with
other agencies, participate in any type of activities involving helicopters or other
types of aerial equipment pursuant to the marijuana eradication program authorized
by Grant Agreement 96-B-13 or any other grants during FY 97-98?
• If the answer is yes, please provide a list of such activities, including dates, purpose
of the activities, locations, other agency involvement, and, if applicable, types of
chemicals or defoliants used.
• Provide a list of all marijuana eradication program-related complaints filed by the
public with your department detailing (1) the date of the complaint; (2) the nature of
the complaint (noise, spraying, etc), and (3) the department's disposition of the
complaints. A copy of any log you maintain would be of great assistance.
• Do you plan or propose to conduct any aerial activities under the proposed grant No.
97-DB-21 and Resolution No. 310-98?

SUBJECT: INQUIRY REQUEST; GRANT AGREEMENT 96-DB-13
Responses to your memorandum of August 27, 1998, regarding our
Department's marijuana eradication program during FY 97-98 are
listed in the order of your inquiries:
1. Yes, several marijuana eradication missions
(Counter- Cannabis Field Operations (CCFO)] were
conducted during FY 97-98, utilizing grant funds
under Grant Agreement 96-DB-13 (Statewide
Marijuana Eradication Task Force project) and the
Domestic Cannabis Eradication/ Suppression Program
(DCE/SP) received from the Drug Enforcement
Administration.
2. Forty (40) CCFO missions were conducted during FY
97-98 to locate and eradicate marijuana plants and
to obtain probable cause to further criminal and
civil action against those responsible for
commercial promotion of marijuana and related
violations without utilizing chemicals,
defoliants, or aerial spray.

operations, the Statewide Task Force concept
promotes, and we receive/ reciprocate, manpower
assistance from various State, Federal and County
law enforcement agencies throughout the State.
Thus far Hawaii County officers have assisted the

Honolulu, Maui and Kauai Police Departments, and
the Department of Land and Natural Resources
(DLNR) CCFO operations.
A general summary of the tasks and assignments to
agencies and personnel during our CCFO missions
include:
1. Aerial reconnaissance observers:
a. Hawaii Army National Guard (HANG) and the Drug
Enforcement Administration (DEA) provide
helicopters and pilots for surveillance and
reconnaissance;
b. Police officer(s) assigned as observer(s)
aboard each aircraft;
C. The function for an observer's aircraft is:
1) To search for and locate cultivated marijuana
plants and to direct an aircraft equipped to
deploy personnel into the location. The method
of deployment may be by "stabo" or rappel
technique, the safest available method;
2) To direct those personnel on the ground to
cultivated marijuana growth;
3) Maintaining security for the safety of ground
personnel through aerial reconnaissance,
especially in dense vegetation;
4) Direct "ground teams" (officers utilizing
ground vehicles) to drive to the directed
location and walk to eradicate marijuana
plants. This method is utilized in specific
areas or when personnel who are not rappel
trained are assisting;
5) To search for, locate and obtain probable cause
to further criminal and civil investigations
against those responsible. Follow-up and
conduct aerial surveillance based on public
information and complaints;

2. Operational Helicopters:
a. Private aircraft, contracted services for a
helicopter and pilot;
b. Trained police personnel are assigned as the rappel
master(s)/observer(s) aboard the aircraft used for:
1) Rappelling and "stabo" (inserting and xtracting
personnel from the field and marijuana plants
out) operations;
2) Transport of plant material from the field to
recovery vehicles;
3) Occasional use to obtain probable cause for
search warrants or to confirm information of
marijuana cultivators received by police.
The following is a list of operations, dates, locations, and
statistics of the aforementioned marijuana eradication program:
07-29/31-97: Eradicated 31,911 marijuana plants,
seedlings to 10 feet, from the following areas:
Maulua Gulch, Laupahoehoe, Pepeekeo, Hawaiian Acres,
Kapoho, Waawaa, Leilani, Fern Forest, and Volcano in
the Districts of Puna, North Hilo, and South Hilo.
Participating agencies: Kauai Police Department
(KPD), Maui Police Department (MPD), Hawaii Volcanoes
National Park (HVNP), HANG, DLNR, and DEA.
08-05/07-97: Eradicated 11,218 marijuana plants,
seedlings to 8 feet, from the following areas:
Hawaiian Ocean View Estates in the District of Ka'u.
Participating agencies: HANG and DEA.
08-11/14-97: Eradicated 53,840 marijuana plants,
seedlings to 14 feet, from the following areas:
Laupahoehoe, Maulua Gulch, New Stable, Hawaiian Acres,
orchidland, Fern Forest, Glenwood, Opihikao, Kalapana,
Pepeekeo, Hakalau, Piihonua, Waiakea Uka, Volcano,
Pahoa, Hawaiian Paradise Park, and Mountain view in
the Districts of Puna, North Hilo, South Hilo, and
Hamakua. Participating agencies: Honolulu Police
Department (HPD), MPD, KPD, HVNP, HANG, DLNR, and DEA.
09-03/05-97: Eradicated 6,557 marijuana plants,
seedlings to 9 feet, from the following areas: South
Kona area. Participating agencies: HANG and DEA.

09-09/11-97: Eradicated 14,777 marijuana plants,
seedlings to 8 feet, from the following areas: Saddle
Road, Mountain View, Eden Roc, Volcano, Orchidland,
Pahoa, Waawaa, Hawaiian Acres, Fern Acres, and
Kukuihaele in the Districts of South Hilo, Puna, and
Hamakua. Participating agencies: HPD, MPD, KPD,
HANG, and DEA.
10-21/24-97: Eradicated 26,226 marijuana plants,
seedlings to 8 feet, from the following areas:
Kapoho, Hawaiian Beaches, Waawaa, Kalapana,
Orchidland, Ainaloa, Tiki Garden, Hawaiian Acres,
Keaau, Kalapana, Pahoa, Volcano, Mountain View, Fern
Forest, Fern Acres, Hamakua Coast, Ahualoa, and
Waipunalei in the Districts of Puna, Hamakua, and
North Hilo. Participating agencies: HPD, KPD, MPD,
HANG, and DEA.
10-28/30-97: Eradicated 3,153 marijuana plants,
seedlings to 6 feet, from the following areas Kona
Palisades and Kona Highlands in the District of Kona.
Participating agencies: HANG and DEA.
11-12/14-97: Eradicated 15,350 marijuana plants,
seedlings to 5 feet, from the following areas:
Mountain View, Keaau, Hawaiian Beaches, Hawaiian
Paradise Park, Leilani Estates, Hawaiian Acres,
Kaumana, Kaiwiki, Pepeekeo, and Laupahoehoe in the
Districts of Puna, South Hilo, and North Hilo.
Participating agencies: HPD, MPD, HANG, HVNP, and DEA.
04-06/09-98: Eradicated 36,655 marijuana plants,
seedlings to 6 feet, from the following areas: Fern
Forest, Fern Acres, Hawaiian Acres, Eden Roc,
Orchidland, Hawaiian Acres, Orchidland, Waipio,
Waipunalei, Hakalau, Honomu, Kaiwiki, and Panaewa in
the Districts of Puna, Hamakua, North Hilo, and South
Hilo. Participating agencies: HPD, MPD, KPD, DLNR,
HANG, and DEA.
04-20/22-98: Eradicated 5,684 marijuana plants,
seedlings to 4 feet, from the following areas Waiohinu
and Milolii in the District of Ka'u and Kona.
Participating agencies: HANG and DEA.
05-12/15-98: Eradicated 21,606 marijuana plants,
seedlings to 6 feet, from the following areas: Fern
Forest, Fern Acres, Kapoho, Nanawale, Waawaa, Hawaiian

Paauilo in the Districts of Hamakua, North Hilo, and

3. During FY 97-98 we recorded forty-five (45)
marijuana eradication program related complaints
and/or comments filed by the public. The

A majority of the calls were helicopter noise complaints,
however, many were appeased and/or satisfied after they learned
that the helicopter activity was the result of a legitimate
police operation. When contacting aircrafts flying in the area
of the reported complaints, we were able to determine that they
were not violating height and/or operational procedures as set
forth by our internal "Procedures for Marijuana Eradication
Operations." Although law enforcement agencies involved in any
enforcement efforts are not governed by Federal Aviation Agency
regulations, these procedures were developed to establish
self-imposed guidelines in consideration of the public's
concerns for helicopter operations during marijuana eradication
missions conducted by our Department.
On several occasions calls to commend and encourage the
continuance of the operations were also received from the
public sector. We further received a number of undocumented
calls throughout the year relating to helicopter noise and/or
low flying aircraft that are not related to any of our
missions. More specifically, calls were received on dates that
the Department did not have any ongoing operations. When

following up on these calls, we were able to determine that
many of the reports were, in fact, the related activities of
other independent governmental agencies such as the Fire
Department, Department of Land and Natural Resources (DLNR),
etc., as well as private companies such as HELCO and commercial
tour helicopter flights.
Copies of the actual individual complaints and/or comments are
enclosed for further information.
4. we do not plan to conduct any aerial activities for the
purpose of marijuana eradication under the proposed
Grant No. 97-DB-21 (Statewide Narcotics Task Force
project) and Resolution No. 310-98. However, it may
become necessary to utilize an aircraft to conduct
aerial observation/ surveillance during an
interdiction-related investigation or enforcement
effort, totally separate of our marijuana eradication
operations.

SUMMARY: Female party complained that about a minute ago a black helicopter
was hanging-over her front yard. She said that they did that before - a few
ears e ad. She said she was working in her yard and at that time she was_

Anonymous male caller wanted to know if spraying was being done
today because he has people in his home (Kau) who have health
problems including himself and that if spraying was done they
needed to leave the area because they would end up in the
hospital. He said this occurred last year when they didn't know
about the spraying and they ended up in the hospital.
I told him that I was not sure and he somewhat sounded
hysterical and asked if I could ask someone. I asked Eva and
she said that the officers are just jumping and pulling plants
today. I told the male party that i got information that the
officers were just jumping and pulling plants. He wanted to
know my name and the agency I'm with. He said he had to call 15
different places before he got the tight number. He said, 'Do
you believe what kind of government we have.,

Female party called and asked If the helicopters could move away from her area
for about 2 hours because she had a baby who was afraid and also wanted to
sleep. She lived mauka of South Point at WOW. I (Jessie) had called Vice via
cellular (936.6947) and advised Det. Saldua of same.
04-21-98, 1220 hours
Henry from Hilo called and said that a male party called Hilo and was swearing
and grumbling about the helicopters. The male party told them that he works
night shins. The male party did not leave his name or his location with Hilo.
04-21-98 0845 hours
f Honomalino called. She saki she lives in a yellow house and
that the vi ra ons bothers her. She said that the helicopters were flying very
low. She asked that we have some courbesy and ask the helkbpters to move.
Call was transferred to Acting Captain John Dawrs.
04-21-98 0850 hours
called and said that he knows VICE has a job to do but that they
a n ave to fly over his property and get his dogs all riled up. He said if VICE
wanted to check his property all they have to do is ask and hell give his consent
to have his property searched. He said he Is not hiding anything and police can
come on his property anytime If they just ask. He said the helicopters are doing
figure 8's and flying low directly over his property. He said that that is
trespassing because they don't have his permission and also that Is harassment.
He further said that he doesn't want to make any trouble but that he wants to be
left alone and that is why he moved 42 feet up Mauna Loa in the middle of no
where. He just wants peace and quiet and to be left alone and the helipcopters
to go away. He said he knows he and his wife has been showing "the finger" to
the cops flying above them and that he knows the cops have atti es about it.
