<br /> <br /> <br /> <br /> <br /> <br /> DECISION AND ORDER <br /> <br /> IT IS HEREBY ORDERED that a portion of the Petition <br /> Area being the subject of this Docket No. A94-705 filed by the <br /> <br /> county of Hawaii Planning Department, comprised of a total of <br /> <br /> approximately 432.91 acres situated in the land divisions from <br /> <br /> Keahuolu to Keauhou, North Kona, Island, County and State of <br /> Hawaii, identified as Hawaii Tax Map Key Nos. 7-4-08: portion of <br /> <br /> 1; 7-5-03: 6, 7; and 7-8-10: portion of 29 and portion of 30, for <br /> <br /> reclassification from the State Land Use Agricultural District to <br /> the State Land Use Urban District, and approximately shown in <br /> <br /> Exhibit "A" attached hereto and incorporated herein by reference, <br /> <br /> shall be and is hereby approved, and the State Land Use District <br /> <br /> Boundaries shall be amended accordingly, subject to the following <br /> conditions: <br /> <br /> 1. Provided that the land uses proposed generate the <br /> <br /> need for such facilities, Petitioner, developers and/or <br /> <br /> landowners of the affected properties, on an individual or <br /> collective basis, shall provide or cause to provide affordable <br /> <br /> housing opportunities for low, low-moderate, and gap group income <br /> <br /> residents of the State of Hawaii to the satisfaction of the <br /> <br /> County of Hawaii. The location and distribution of the <br /> affordable housing or other provisions for affordable housing <br /> <br /> shall be under such terms as may be mutually agreeable between <br /> <br /> the developers and/or landowners and the County of Hawaii. <br /> 2. Provided that the land uses proposed generate the <br /> <br /> need for such facilities, Petitioner shall ensure that the <br /> <br /> developers and landowners of the affected properties and their <br /> <br /> -50- <br />
