Arakaki, Chairman and Members of the County Council County of Hawaii 25 Aupuni Street Hilo, HI 96720 Dear Chairman Arakaki and Members: Change of Zone Application (REZ 91-16) Applicant: David Matsuura Request: A-20a to A-5a Tax Man Key: 1-7-13:08 The Planning Commission, after a duly held public hearing on September 18, 1998, voted to recommend for your approval the proposed legislative bill to change the district classification for approximately 30.511 t acres of land from Agricultural (A-20a) to Agricultural (A-5a). The property is located at the northeast comer of Volcano Road and Enos Road, Olaa, Puna, Hawaii. The Commission concurs with the following Planning Director's reasons for recommending favorable consideration of the change of zone: In order to consider any area for any type of zoning designation, the applicable goals, policies, and standards of the General Plan must be adequately addressed. It is only through such a comprehensive policy analysis approach that evaluations and decisions can be made to better time and stage developments to achieve quality growth determined by the General Plan and related planning documents. The implications of these evaluations and decisions must also be considered as they may have an impact on other similar areas in the County. Honorable James Y. Arakaki, Chairman and Members of the County Council Page 2 The proposed Change of Zone from an Agricultural (A-20a) to an Agricultural (A-5a) zoned district would conform to the following goals, policies and standards of the Land Use and Agriculture Elements of the General Plan: * Designate and allocate land uses in appropriate proportions and mix and in keeping with the social, cultural and physical environments of the County. * Zone urban- and rural-types of uses in areas with ease of access to community services and employment centers and with adequate public utilities and facilities. * The County shall encourage the development and maintenance of communities meeting the needs of its residents in balance with the physical and social environment. * Zoning requests shall be reviewed with respect to the General Plan designation, district goals, regional plans, State Land Use District, compatibility with adjacent zoned uses, availability of public services and utilities, access, and public need. * Rural-style residential-agricultural developments, such as new small-scale rural communities or extensions of existing rural communities, shall be encouraged in appropriate locations. The Land Use Pattern Allocation Guide (LUPAG) Map component of the General Plan is a representation of the document's goals, policies, standards and courses of action to guide the coordinated growth and development of the County. It reflects a graphic depiction of the physical relationship among the various land uses. The LUPAG Map establishes the basic urban and non-urban land use pattern for areas within the County. The proposed change of zone request conforms to the LUPAG Map, which designates the area for Orchard. Such a designation are those agricultural lands which though rocky in character and content, support productive macadamia nuts, papaya, citrus and other similar agricultural products. The requested Agricultural (A-5a) designation would allow for residential, agricultural and related use of the subject property in a manner which would not be contrary to the uses permitted within the area designated Orchard. The subject property is situated within the State Land Use Agricultural District. The applicant's proposal to develop agricultural lots is consistent with the requirements of Chapter 205, Hawaii Revised Statutes, otherwise known as the State Land Use Law. A condition will be included to require the applicant to comply with the requirements of the State Land Use Law and the Zoning; Honorable James Y. Arakaki, Chairman and Members of the County Council Page 3 Code. The proposed zone change would promote a low density residential-agricultural development as well as provide opportunities for small-scale agricultural activities which would be compatible with the surrounding area. The Land Study Bureau's Overall Master Productivity Rating is "D" or "Poor." The applicant intends to develop the subject property into four lots ranging in size from approximately 7 to 9.511 acres in size. Such development would allow the applicant to convey the proposed lots to family members for the small-scale farming of pasture and other small crops. Also, while the result would be the creation of lots for residential purposes, the proposal would still be in keeping with the General Plan LUPAG Map for Orchard. The subject property is located in close proximity to schools, commercial areas, employment centers and public safety services. Access to the subject property is from the Volcano Highway (Highway 11) to Enos Road, a County maintained road with a 30-foot right-of-way. The pavement is in good condition, approximately 10 to 13 feet wide with 3-foot wide grass shoulders. The Department of Public Works recommends widening the pavement to a 20-foot wide pavement with 5-foot grass shoulders and provide any necessary drainage improvements, meeting with the approval of the Department of Public Works. Further, a 10-foot future road widening setback along the entire frontage of the subject property shall be subdivided and dedicated to the County. The State Department of Transportation recommends that the applicant provide a 20-foot setback along the State Highway (Volcano Road) right-of-way for future roadway improvements. No access shall be permitted from Volcano Road. A condition will be included to address the Department of Transportation's recommendations. According to the Department of Water Supply, the department is pursuing various improvements to the Olaa Water System along the Volcano Highway fronting the subject property. These improvements include the installation of new reservoirs at the existing reservoir site Nos. 5 & 6, along with a 12-inch waterline replacement from reservoir site No. 5 to reservoir site No. 6. The waterline replacement and new reservoir at site No. 5 are under design and should be under construction in fiscal year 1998. Once the site acquisition for the new reservoir at site No. 6 is completed, design and construction will follow. Therefore, the Department of Water Supply has no objections to the subject request. However, water commitments cannot be issued at this time until construction contracts for these improvement projects are executed. A condition will be included that the zoning will be effective when the required water commitment payment is submitted to the Department of Water Supply. All other essential utilities and services are or will be made available for the proposed development. The property has no severe topographic or geologic problems which cannot be properly rectified or which would render the land unusable for the proposed Honorable James Y. There are two existing residential structures, an agricultural storage. building, a pump storage building, and three greenhouses on the subject property. Therefore, it is not anticipated that endangered or threatened candidate species of flora or fauna nor significant archaeological sites are located on the subject property. Based on the foregoing, approval of the change of zone request from A-20a to A-5a would result in an appropriate land use pattern that will further the necessity, convenience and welfare of the general public. For your favorable consideration, an amendment to Section 25-8-24, the Kurtistown Zone Map, of the County Zoning Code is transmitted. Landowner Authorization: The landowner of the subject property is Ruth Matsuura et al. By letter of authorization on file, the other owners have granted permission for David Matsuura to apply for the subject application. APPLICANT'S REQUEST 2. Request: The applicant is requesting a change of zone in order to allow a proposed subdivision of four lots to be deeded to family members for agricultural and residential use. These lots will be family farms of Orchid Isle Nursery, Cedar Fame and Dendrobium Farm. 3. Plans Submitted: Proposed plans indicate a parcel approximately 30 acres in size. The property is proposed to be subdivided into four lots ranging in size from 7 to 9.511 acres. 4. Supportive Information: (See Exhibit A - Applicant's Change of Zone application) STATE AND COUNTY PLANS 5. SLU: Agricultural. 6. General Plan LUPAG Map: Orchard. 7. County Zoning: Agricultural 20-acres (A-20a). 8. SMA: The subject property is not within the Special Management Area boundary. DESCRIPTION OF PROPERTY AND SURROUNDING AREA 9. Subject Property: The subject property is located on the northeastern corner of ATTACH. C-1011 (B-308) Volcano Road and Enos Road and is approximately 30.511tacres in size. The property is relatively level, and there are two dwellings, an agricultural storage building, a pump storage building and three greenhouses on the subject property. One dwelling is a two-story structure approximately 1,688 square foot in size, and constructed in 1992. The second dwelling is a single story structure approximately 3,600 square foot in size, and constructed in 1996. Palms border the property fronting the Volcano Highway, and there are citrus trees and cymbidiums growing on the property. 10. FERM: Zone "X", or area determined to be outside the 500-year flood plain. 11. ALISH: Unclassified. 12. USDA Natural Resources Conservation Service's Soil Survey Report: Ohia extremely stony silty clay loam 0-20% slopes (OSD). Runoff is slow to medium, erosion hazard is slight to moderate. The soil is used for sugarcane, woodland and pasture. 13. Land Study Bureau Soil Rating: "D" or Poor. 14. Floral/Faunal and Archaeological Resources: Since the property has already been disturbed, the likelihood of any endangered flora and fauna or archaeological features are remote. 15. Surrounding Zoning/Land Uses: Lands to the north are zoned Agricultural 20-acres (A-20a) and vacant. Lands to the south and southeast across Volcano Road, are zoned Single Family Residential 20,000-square feet (RS-20), Agricultural 10-acres (A- l0a), and Agricultural 20-acres (A-20a), and include existing dwellings and vacant lots. West of the subject property are lands zoned RA-.5a and include lands in agricultural/residential uses. PUBLIC FACILITIES AND SERVICES 16. Access: Access to the property is from Enos Road, a County-maintained road with a 30-foot right-of-way. The pavement is in good condition and is 10 to 13 feet wide. The grass shoulder width is 3 feet. However, according to the Department of Public Works, the right-of-way and pavement should be widened if this change of zone is -2- approved. 17. Water: According to the Department of Water Supply, water is available to the site from an existing 6-inch waterline along Volcano Highway that is limited to a maximum allotment of 600 gpd or one unit of water. 18. Wastewater: Wastewater is disposed of into an existing cesspool. 19. Other Essential Utilities and Services: Electricity, telephone, and other services are available to the site. AGENCIES' COMMENTS 20. Department of Water Supply (February 5, 1998 Memo): "We have reviewed the subject application for the proposed change of zone and have the following comments. "Please be informed that the Department's existing water system facilities cannot support the proposed subdivision at this time. Extensive improvements and additions, including source, storage, transmission, booster pumps, and distribution facilities, must be constructed. Currently, sufficient funding is not available and no time schedule is set." 21. Police Department (February 10, 1998 Memo): "We reviewed the above-referenced change of zone application and have no comments or objections to offer at this time." 22. Real Property Tax Office (February 2, 1998 Memo): "Property is receiving agricultural use value. "16 acres of this property are in the agricultural use program. "Current - Real Property taxes are paid through December 31, 1997. 23. Department of Health (February 2, 1998 Memo): "The Health Department found no environmental health concerns with regulatory implications in the submittals." 24. State Land Use Commission (February 5, 1998 Letter): "We have reviewed the subject change of zone application as transmitted by your -3- memorandum dated January 27, 1998, and confirm that the subject parcel, identified as TMK: 1-7-13:8, is within the State Land Use Agricultural District. "We have no further comment to offer at this time." 25. Department of Land and Natural Resources (February 20, 1998 Letter): "This is in reply to your Memorandum of January 27, 1998 regarding the above- referenced Change of Zone application. "We have no record of historic sites on the subject parcel. It is unlikely that any would still exist on this property, which according to the maps in our office is old sugarcane cropland. Based on this information, we believe that the Change of Zone Application will have "no effect" on significant historic sites." 26. I have asked Mr. Roy nakamoto our attorney to attach an easement onto our railroad easement to the twelve acre parcel that was landlocked (As we discussedl. I will send you a copy of the papers when Mr. Cakamoto finishes it. As you may know building a farm and a house is very diffi- cult these days. My parents and I purchased this 30 acre lot to help all of my brothers, sister and I get started on our own farms. All of these lots will be used for some form of diversi- fied agriculture (ex nurseries, field stock). The main reason we want to break this lot up into separate lots (TMKs) is that in order to obtain a young farmer loan or any other loan we would have to each own our own respective lots. A] so it will alleviate any future family problems if a dispute arises. This subdivision will allow my younger brother (Andrew) and sister (Caroline) to have a place to build their very own farm and home for the first time. My other brother and I already have existing farms but we need a place for the future since both he and I lease part or all of our own respective farms. We would like to centralize all of our farms in one location to help cut down on expenses Central- izing will allow us to cut costs and become more efficient. We do not want to subdivide this parcel for any type of sperulation purpose. All forms of agriculture is taking a beating{ these days. With the influx of cheap foreign products as well as the constant increase in the costs of doing business we havt~ found that we need to help each other in order to survive. With the price of land these days. purchasing a large lot and breaking it up is the only way we have found to actually having a chance of making it in farming.
