Page 2 <br />.B. NO. <br />1 (1) One hundred [~] percent of the renewable <br />2 portfolio <br />3 standards shall be met by electrical energy <br />4 generated using renewable energy as the source; <br />5 (2) Where electrical energy is generated or displaced <br />6 by a combination of renewable and nonrenewable <br />7 means, the proportion attributable to the <br />S renewable means shall be credited as renewable <br />9 energy; and <br />t0 (3) Where fossil and renewable fuels are co-fired in <br />II the same generating unit, the unit shall be <br />12 considered to generate renewable electrical <br />13 energy (electricity) in direct proportion to the <br />14 percentage of the total heat value represented by <br />15 the heat value of the renewable fuels. <br />16 (c) If the public utilities commission determines <br />17 That an electric utility company failed to meet the renewable <br />IS portfolio standard, after a hearing in accordance with chapter <br />19 91, the utility shall be subject to penalties to be established <br />20 by the public utilities commission; provided that if the <br />21 commission determines that the electric utility company is <br />22 unable to meet the renewable portfolio standards due to reasons <br />
