REPORT OF THE <br /> COMMITTEE ON PLANNING <br /> DATE: June15, 1998 Re: C-2331Bi11 No. 52 <br /> PLACE: Councilroom <br /> TIME: 1:36 p.m. <br /> Chair and Members <br /> Hawaii County Council <br /> Hilo, Hawaii 96720 <br /> Your Committee on Planning to which was referred Bill No. 52, trmsmitted by Mayor Stephen K. <br /> Yamashiro per Communication No. 233, dated February 17, 1995, regarding the change of zone <br /> Ordinance No. 90-144 request by Wainaku Congregation of Jehovah's Witnesses at Paukaa, South <br /> Hilo, Hawaii, TMK: 2-7-38:3, reports as follows: <br /> Bill No. 52 amends Ordinance No. 90-144, which reclassified 7.184 acres of land from Agricultural <br /> (A-20a) to Agricultural (A-3a), by amending Condition B to allow for an extension of time to resubmit a <br /> Subdivision Application and subsequently to secure Final Subdivision Approval. <br /> The applicant had initially submitted a Subdivision Application (91-168) on October 23, 1991, within the <br /> one year time frame called for by Ordinance 90-144. Tentative Approval was granted on May 23, 1992, <br /> and Final Subdivision Approval was supposed to have been issued prior to May 23, 1993. The <br /> applicant's failure to obtain Final Subdivision Approval by May 23, 1993 resulted in the Subdivision <br /> Application 91-168 being declared null and void on February 9, 1994. The amendment to Condition B in <br /> Bill No. 52 allows the applicant to re-initiate the subdivision process. <br /> The Planning Commission, at its January 26, 1995 meeting, recommended approval of the applicant's <br /> request to amend Condition B of Ordinance No. 90-144 to allow for an extension of time to resubmit the <br /> Subdivision Application and subsequently to secure Final Subdivision Approval. The request was <br /> submitted to the Committee on Planning in March L995, however, no action was taken.
