i y <br /> REPORT OF THE <br /> COMMITTEE ON PLANNING <br /> DATE: February 17, 1998 Re: C-703/Bill No. 197 <br /> PLACE: Councilroom <br /> TIME: 1:46 p.m. <br /> Chair and Members <br /> Hawaii County Council <br /> Hilo, Hawaii 96720 <br /> Your Committee on Planning, to which was referred Bill No. 197, transmitted by Mayor Stephen <br /> K. Yamashiro per Communication No. 703, dated January 29, 1998, amending Chapter 25 of the <br /> Hawaii County Code, relating to zoning reports as follows: <br /> Bill No. 197 amends Section 25-2-3 (Review and Acceptance of Applications) of Chapter 25 <br /> (Zoning Code) of the Hawaii County Code, by adding the new language regazding the <br /> certification of clearance from the Director of Finance in regard to real property taxes. <br /> Bill No. 197, initiated by the Planning Director and drafted by the Corporation Counsel, deals <br /> with the inconsistency which results when the County issues zoning or permit concessions to <br /> those who do not pay real property taxes on the benefited property, or who have allowed other <br /> delinquencies related to the property to occur. The proposed provision will require all <br /> applications, filed with the Planning Director or the Planning Commission, to be accompanied by <br /> a Certificate of Cleazance from the Director of Finance to verify that the subject real property <br /> taxes and al] other fees have been paid and that there aze no outstanding delinquencies. <br /> Your Committee articulated that this new law will apply only to new applications and will not <br /> retroactively apply to previous applications.
