PC- ~ ~ Page 3 September 2, 1997
Your Committee amended Condition D of Bill No. 129 by adding language requiring that the
APD shall not exceed seven lots and Condition H clarifying the intent and purpose of APD
district by the following:
1. Requiring that the subject property be subdivided into no more than seven (7)
lots;
2. Clarifying that 85% of the total land azeas within each proposed lot be retained in
its existing orchazd use or other agricultural uses such as crop production,
floriculture, nurseries and similaz uses dealing with the growing of plants; and
3. Clarifying that prior to any new proposed agricultural use other than the existing
or permitted uses identified in H(2), the new proposed use will be considered as
an amendment to the APD and processed for Council approval.
Recognizing that the Agricultural Project District (APD) is similar to the concept of a Planned
Unit Development (PUD), the APD allows flexibility in lot sizes and improvements to
infrastructure with the intent that agriculture will be preserved. It also grants the Council the
authority rather than the administration to set any limits or conditions. Each application would
be considered on a case by case basis.
Many of the restrictions for the APD which were proposed by the applicant, is intended to allow
the diversification of ownership and stewazdship of the land which will result in the substantial
preservation of the existing orchazd and opportunities for residential use.
Your Committee on Planning is in accord with the intent and purpose of Bill No. 129, Draft 2,
and recommends that it pass first reading.
CES
AYES NOES A&E EX Respectfully submitted
LEITHEAD-TODD X COMMITTEE t~1 P~~INING

TYLER X %

CHUNG X ~~e%>~-/fC~LClll~ .G(J
REYNOLDS X ~O~ JEAN LEITHEAD-TOD ,CHAIR

SAN'rANGELG

SMITH X PC REPORT NO. ~ ~

vacoNG X ADOPTED:

ARAKAKI E.O.M.
