County of Hawaii <br />PLANNING COMMISSION <br />Aupuni Center • 101 Pauahi Street, Suite 3 • Hilo, Hawaii 96720 <br />Phone (808) 96I-8288 • Fax (808) 961-8742 <br />October 24, 2008 <br />Pete Hoffmann, Chairman <br />and Members of the County Council <br />County of Hawaii <br />333 Kilauea Avenue, 2"d Floor <br />Hilo, HI 96720 <br />Dear Chairman Hoffmann and Council Members: <br />County Council Initiated <br />Amendment to Chapter 25 (Zoning Code), Article 2, Division 4, <br />Section 25-2-46, Hawaii County Code 1983 (2005 Edition, As Amended) <br />Relating to Concurrency Conditions for Parks and Recreational Facilities, <br />Wastewater Treatment Facilities, and Police and Firefightin>; Facilities <br />The Planning Commission conducted hearings on October 3, 2008 and October 17, 2008, <br />to review the County Council initiated request for an amendment to Chapter 25 (Zoning <br />Code), Article 2, Division 4, Section 25-2-46, Hawaii County Code 1983 (2005 edition, <br />as amended) relating to Concurrency conditions for parks and recreational facilities, <br />wastewater treatment facilities, and police and firefighting facilities. At its meeting of <br />October 17, 2008, the Commission voted to send an unfavorable recommendation [o the <br />County Council's proposed draft bill as contained in Resolution No. 686 08. The <br />Commission also added that there should be an emphasis to refer to the respective <br />community development plans rather than the application of an island-wide rule. <br />The Commission concurs with the Planning Director's unfavorable recommendation as <br />follows: <br />The Planning Director recommends that the Planning Commission send a <br />negative recommendation to the Council on the proposed amendment to the <br />Zoning Code. Because the County does not currently meet the proposed <br />standards, especially for police and parks, the bill would create a moratorium on <br />rezoning in the County for all districts. For Puna, North Kona, South Kona, and <br />South Kohala, the ban on new zoning would last until the County more than <br />Hawaii County is mt Egual Opportwlity Provider mld Employer <br />
