No. 1452/Res. 750-08', <br /> PLACE: Council Chambers <br /> Ben Franklin Bldg, 2"d Floor <br /> Hilo, Hawaii 96720 <br /> <br /> TIME: 11:28 a.m. <br /> <br /> Council Chair and Members <br /> Hawaii County Council <br /> Hilo, Hawaii 96720 <br /> <br /> Your Committee on Public Works and Intergovernmental Relations, to which was referred <br /> Communication No. 1452, regarding Resolution 750-08, reports as follows: <br /> <br /> Resolution 750-08, transmitted by Assistant Corporation Counsel Gerald Takase via <br /> Communication No. 1452, dated September 8, 2008, Accepting the Dedication of Roadway Lot <br /> "C", being Tax Map Key: (3)2-5-061:080, Situate at Kukuau Second, District of South Hilo, <br /> County and State of Hawaii, from Brilhante-Hawaii, Inc. <br /> <br /> Article XIII, § 13-12 of the Hawaii County Charter provides that the Council may accept gifts <br /> which include the dedication of land, on behalf of the County of Hawaii. <br /> <br /> Brilhante-Hawaii, Inc. is desirous of dedicating Road Lot "C", including all subdivision "i <br /> improvements to the County of Hawaii for road and drainage purposes. <br /> <br /> There was no testimony from members of the public regarding the proposed resolution. <br /> <br /> Assistant Corporation Counsel Gerald Takase appeared before your committee. Mr. Takase <br /> confirmed the roadway including all improvements are in full compliance with the provisions of <br /> Chapter 23 of the Hawaii County Code. <br /> <br /> Council member Dominic Yagong questioned why Road Lot "C" (cul-de-sac) was not included; <br /> with the dedication of Kristiano Street and if it is standard for the County of Hawaii to own a <br /> cul-de-sac. Assistant Corporation Council Takase commented that Road Lot "C" (cul-de-sac) <br /> could have been part of a second phase of this subdivision and might not have been completed at <br /> the time of the dedication of Kristiano Street to Hawaii County. <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> P W IRC RPT NO. 97 <br /> i <br />
