COUNTY OF HAWAII <br />STATE OF HAWAII <br />RESOLUTION NO. 823 ®S <br />A RESOLUTION ENCOURAGING THE STATE OF HAWAII TO WORK WITH THE <br />COUNTY OF HAWAII IN THE PLANNING, DEVELOPMENT, MITIGATION, AND <br />IMPLEMENTATION PROCESS PRIOR TO THE PROPOSED OPERATION OF THE <br />SUPERFERRY TO HAWAII ISLAND. <br />WHEREAS, in November 2007, the Honorable Governor Linda Lingle determined it <br />was in the public interest to allow a large capacity ferry vessel to begin service as soon as ' <br />possible between Oahu, Maui, Kauai and Hawaii and to use state harbor=-facilities while harbor <br />improvements were being constructed and while environmental studies, environmental <br />assessments or environmental impact statements were being conducted and prepared; and <br />WHEREAS, Governor Lingle, pursuant to Act 2 of the Second Special Session Laws of <br />Hawaii 2007 ("Act 2"), enacted Executive Order Nn. 07-10, establishing conditions and <br />protocols to address the effects a large capacity ferry may have on ocean life and marine animals <br />and plants, whale avoidance policy and procedures, water resources and quality, harbor <br />infrastructure, vehicular traffic, public safety and security, controlling the spread of invasive <br />species, cultural resources (including hunting, fishing and native Hawaiian resources) and <br />economic consequences; and <br />WHEREAS, the temporary Hawaii inter-island ferry oversight task force, which was <br />established pursuant to Act 2, will conclude its review of ferry operations and complete its <br />examination of impacts by December 2008; and <br />WHEREAS, the Hawaii County Council finds that it is imperative that the State of <br />Hawaii work together with the administration, legislative body and citizens of the County of <br />Hawaii to ensure public safety, appropriate infrastructure and public services, economic <br />sustainability, cultural sensitivity and protection, resource management, and environmental <br />protection prior to commencing Superferry service to Hawaii Island; now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the <br />State of Hawaii is requested to actively include the appropriate County agencies in every aspect <br />of discussion and decision-making relating to infrastructure and construction planning, <br />development of protective measures, and the devising of implementation procedures and <br />economic strategies prior to the commencement of Superferry services to Hawaii Island; and <br />BE IT FURTHER RESOLVED that these actions be taken to ensure that the health, <br />safety, and welfare of the people of Hawaii Island receive the highest consideration; and <br />BE IT FINALLY RESOLVED that the County Clerk shall forward certified copies of <br />this resolution to the Honorable Governor Linda Lingle, the Honorable Mayor of the County of <br />Hawaii, the Chair of the Board of Land and Natural Resources, the Director of the Department <br />
