REPORT OF THE
COMMITTEE ON FINANCE
DATE: June 2, 1998 Re: Comm. No. 862/Res. No. 279-98
PLACE: Councilroom
TIME: 10:45 A.M.
Chair and Members
Hawaii County Council
Hilo, Hawaii 96720
Your Committee on Finance, to which was referred Resolution No. 279-98, reports as follows:
Resolution No. 279-98, transmitted by Council Member J. Curtis Tyler, III, via Communication
No. 862, dated May 20, 1998, requests the Mayor to negotiate with SoBay Hawaii, Inc. for
acquisition of certain beachfront property at Wai'aha Bay, North Kona, Hawaii, designated as
TMK:(3)7-5-018:020.
Currently, SoBay Hawaii, Inc. owns the beachfront property at Wai'aha Bay, North Kona,
designated as TMK (3)7-5-018:020, and is planning to develop a 21-unit condominium
consisting of 4-stories and an underground parking gazage thereon. The subject property is rich
in natural beauty and contains one of the few white sand beaches in Kona. This land and
Wai'aha Bay, also known as Honl's, are used by many residents and visitors alike for various
recreational activities.
[n accordance with various sections of the Hawaii County General Plan, the County is mandated
to protect, preserve and enhance the quality of such areas. Furthermore, the Plan establishes a
policy to maintain the shoreline of Hawaii for recreational, educational, and/or scientific uses.
Recognizing the opposition of SoBay Hawaii's proposed project by many island residents, and to

be consistent with the Hawaii County General Plan, Resolution No. 279-98 requests the Mayor
to negotiate with SoBay Hawaii, Inc. to acquire the beachfront parcel at Wai'aha Bay.
Your Committee on Finance is in accord with the purpose and intent of Resolution No. 279-98
and recommends its adoption.
Ici
Ayes rvaes A&8 ex Respectfully submitted
CHUNC X
LEITHEAD-TODD X COMMITTEE ON FINANCE
RAY X
SANTANGELO X
SMITH X
TvLER X AARON S.Y.
