On Monday, December 22, 2008, I attended the monthly~HSA~C1]/xeeutiv
on Oahu. Also in attendance were: HSAC Acting-President~.D~ e're&'Kawa

Greenwell. A copy of the meeting agenda is attached for your review.
I reported to the board that we had established an "ad hoc" committee on
Joe Pontanilla mentioned that if we need information, he is willing to hell
first reading on a resolution on having the State and Federal agencies he1F
problem in East Hawaii.
Maui reported about their Bed and Breakfast bill that they passed.
Oahu reported about their mayor's MainStreet Economic Recovery Surve
He also reported about heavy rains and flood damages on Oahu.

Meeting
Kauai reported about their Habitat Conservation which included topics of sheaz water and
alternative energy. The HSAC conference will be on June 17 and 18, 2009. There will be a
golf tournament. The board approved $2,000.00 as a start up to help them for the hotel deposit
($1,500.00) and expenses ($500.00).

Riki Hokama (NACO Representative) made his report about the upcoming conference and
stated that we should push for more "transportation funds". NACO will keep the dues the same
and will push to go more "green". They will be also changing the way they do their selections
of chairs. The "WRI" is asking if Hawaii wants to host next yeaz's conference and which
island would be the host. Riki mentioned that it takes a lot of money and energy and everyone
would need to help. He also mentioned that the membership will need to attend because in the
past there was a low turnout.
Meeting minutes from November 24, 2008 were approved and are attached here for your
review. The treasurer's report for November 2008 was filed.
We will need to approve the newly proposed officers for 2009 as follows:
President Nester Garcia-Oahu
Vice-President Derek Kawakami-Kauai
Secretary Dennis Onishi-Hawaii
Treasurer Joe Pontanilla-Maui
Once we decide on this matter, I will then give the board Hawaii's decision.
Councilman Kelly Greenwell spoke about how the "sunshine law" needs to be changed. He
also mentioned about how we all need to go and get the money from the "farm bill" and
someone mentioned about talking to Rep. Neil Abercrombie and Sen. Daniel Inouye.

B. Executive Committee Reports
The following Executive Committee reports were approved:
Report of official action taken at the October 20, 2008, Executive
Committee Meeting approving a resolution in support of the
recovery of the Hawaii State Mammal, the Critically Endangered
Endemic Hawaiian Monk Seal.
2. Report of official action taken at the October 20, 2008, Executive
Committee Meeting approving and referring to the county councils
seven items for inclusion in the 2009 HSAC Legislative Package.
C. County Reports
Maui Countv Report. Treasurer Pontanilla reported that Maui Mayor
Tavares has instructed the county's departments to reduce their FY 2009
budgets by 16 percent.
Hawaii Countv Report. Vice President Jacobson reported that Dennis
Onishi will be his replacement for HSAC, with Kelly Greenwell as
alternate.
City and Countv of Honolulu Reoort. Secretary Garcia reported on
legislation currently under consideration by the Honolulu Council: 1) Bill
67 (2008) regarding the use of electronic devices while driving, 2) Bill 6
(2008) regarding the regulation of bed and breakfast homes, and 3) Bill 64
(2008) regarding changing the transit system route.
Kauai Countv Report. President Rapozo reported that prior to the General
Election, the Kauai Council had selected Councilmember Kouchi as the
HSAC representative with Councilmember Kaneshiro as the alternate.
However, since Councilmember Kouchi was not re-elected,
Councilmember Kaneshiro will act as HSAC President at the December
2008 meeting.
D. National Association of Counties (NACo) Report
President Rapozo reviewed the status of the NACo board members.
Kauai Councilmember Iseri-Carvalho will serve on the board until her term
expires. Honolulu Councilmember Dela Cruz will continue to serve as the
President's appointee. Maui Councilmember Pontanilla will replace Maui
Council Chair Hokama on the NACo board.

E. Western Interstate Region (WIR) Report
Vice President Jacobson indicated that Hawaii County will act to_provide_a .
replacement for him on the WIR board. Kauai staff Ayonon suggested
that the county councils select replacements for the NACo/WIR boards
prior to the next HSAC meeting.
President Rapozo stated that consideration should be given to designating,
the City and County of Honolulu instead of Hawaii County for the WIR
board position. President Rapozo stated that in the event that HSAC
loses the Presidential appointee position, Honolulu would have no
positions on NACo or WIR boards.
IV. UNFINISHED BUSINESS
A. 2009 HSAC Legislative Package
President Rapozo reported that the HSAC package proposals relating to
product branding and labeling, renewable energy portfolio standards, and
public, educational, and governmental (PEG) access organizations failed
to be adopted by all the county councils.
Vice President Jacobson expressed his disappointment that the other
counties did not support the product branding and labeling legislative
proposal. Vice President Jacobson stated it is likely that the Hawaii
Council will continue to pursue such legislation vigorously in order to
protect local agricultural industries. Secretary Pontanilla stated that the
Maui Council had concerns regarding the legislation and did not receive
information from the chambers of commerce or the farm bureau.
Secretary Garcia indicated that the Honolulu Council's Intergovernmental
Affairs Committee deferred the product branding and labeling and
renewable energy portfolio standard proposals because the Maui Council
had failed to advance the measures. Secretary Garcia stated that the
Honolulu Council will continue to seek a resolution of the PEG access
issue.
B. Communication dated October 8, 2008, from Governor Linda Lingle
regarding receipt of HSAC resolution in support of the National
Association of Counties Initiative Against Child Sexual Exploitation.
The communication was received.
C. Communication dated November 12, 2008, from Roy T. Hiraga, County
Clerk, County of Maui, transmitting a copy of Committee Report No.
08-142, which was adopted by the Council of the County of Maui at its
meeting held on November 7, 2008, approving for inclusion in the 2009
HSAC Legislative Package:
A proposed State bill entitled "A BILL FOR AN ACT RELATING TO
HOUSING";
2. A proposed State bill entitled "A BILL FOR AN ACT RELATING TO
PROCUREMENT";
3. A proposed State bill entitled "A BILL FOR AN ACT RELATING TO
CRIMINAL HISTORY RECORD CHECKS BY COUNTIES"; and
4. A proposed State bill entitled "A BILL FOR AN ACT RELATING TO
TRAFFIC INFRACTIONS."
The communication was received.
The 2009 HSAC legislative package consisting of the four items listed
above was approved.
Secretary Garcia indicated that his office will work with the Kauai council
office to process the legislative package.
Secretary Garcia requested clarification regarding lobbying efforts for the
HSAC legislative package. President Rapozo indicated that HSAC has
made a practice of sponsoring aget-together with key members of the
legislature to present the package. President Rapozo further indicated
that all members must take personal responsibility with respect to lobbying
for the measures.
Secretary Garcia suggested that HSAC or the council chairs consider
taking a role in the legislative budget presentations. Vice President
Jacobson indicated that the Hawaii Council's past practice has been to
endorse the mayor's legislative package and also to sponsor its own
package. Secretary Garcia indicated that he would consider suggesting
that the Honolulu Council have a legislative package of its own. Treasurer
Pontanilla indicated that the Maui Council has its own legislative package
and lobbyist. President Rapozo discussed the Kauai Council's experience
with respect to its legislative package and the hiring of a lobbyist.
President Rapozo stated that HSAC needs to have a lobbyist and that
funds should be raised and budgeted for that purpose.
Secretary Garcia requested clarification regarding the Executive
Committee's ability to adopt a position on a legislative item in mid-session.
President Rapozo replied that the Executive Committee is authorized to

take such a position provided it does so by unanimous vote, although in
doing so, each member is ultimately accountable to his or her own council.
Secretary Garcia noted that his inquiries relate to the possibility that the
county excise tax surcharge for transportation may become an issue in the
coming session.
V. NEW BUSINESS
A. Kauai County Council's Representative to the HSAC Executive Committee
President Rapozo stated that the Kauai Council had approved
Councilmember Kouchi as the HSAC representative and Councilmember
Kaneshiro as the alternate, but since Councilmember Kouchi will be
leaving the council in December, Councilmember Kaneshiro will act as the
HSAC representative. President Rapozo indicated that Councilmember-
elect Derek Kawakami and Councilmember Kaneshiro have expressed an
interest in serving as the HSAC representative and alternate, respectively.
President Rapozo stated that the Executive Committee may wish to
consider the leadership of HSAC at its next meeting.
The Kauai HSAC representative was approved.
VI. ANNOUNCEMENTS
A. Schedule of Upcoming HSAC Meetings.
The next meeting will be held December 18, 2008, at 10:00 a.m. at
Honolulu Hale, with December 22, 2008, as the alternate date: President
Rapozo stated that Councilmember Darryl Kaneshiro will act as President
at that meeting.
B. Other Announcements
Treasurer Pontanilla indicated that for the past two years only one
person has responded to bids to undertake the HSAC audit. To
avoid late tax filings, Treasurer Pontanilla intends to arrange for a
one-year HSAC audit contract with the option to cancel the contract
or extend it for another year.
2. Kauai Councilmember Iseri-Carvalho requested that the committee
provide a certificate of condolence for NACo boardmember Bruce
Elwell, who recently passed away. Services were held on
November 22. Kauai staff Ayonon and Honolulu staff Segami agreed
to prepare a certificate for the members' signatures.

3. President Rapozo indicated that Kauai County will find out in
December whether or not it has been awarded the bid to host the
2010 WIR conference.
4. President Rapozo and Vice President Jacobson expressed their
appreciation for being allowed to serve on the HSAC Executive
Committee. Secretary Garcia and Treasurer Pontanilla thanked them
for their service.

There being no further business, the meeting was adjourned at 11:27 a.m.

Heavy Rains/Flood Damage on Oahu
^ Hardest hit areas are in aianae, North Shore, and-Windw~-Oahu.
^ • Approximately 200 homes sustained damage.
o Of those homes, approximately 50 sustained major damage.
^ 6 shelters were opened for victims of the flooding, although as of Dec 18
only the Laie shelter was still open
^ State, City and non-profits jointly ran DARCs (Disaster Assistance and
Recovery Centers) this past week, although it looks like they do not have '
any more scheduled.
