<br />r <br />facilitate the general motoring public's use of such an easement, and the area <br />covered by the easement, if the northerly portion of the Mamalahoa <br />Highway Bypass and easterly (mauka) portion of the Haleki'i Street <br />Extension were available for such use; and <br />WHEREAS, the Grantor, Hokuli'a lot owners, their respective <br />employees, guests, invitees and contractors and other persons who are <br />designated and authorized by the Grantor, including without limitation, <br />owners of parcels located in the coastal area near or adjoining the Hokuli'a <br />project, will continue to use the northerly portion of the Mamalahoa <br />Highway Bypass and easterly (mauka) portion of the Haleki'i Street <br />Extension for their own, respective uses and intend to maintain such uses <br />without interruption, interference or hindrance resulting from the general <br />motoring public's use of the northerly portion of the Mamalahoa Highway <br />Bypass and easterly (mauka) portion of the Haleki'i Street Extension; and <br />WHEREAS, the Grantor is willing, for the benefit of the <br />community, to accommodate the Grantee's desire to provide for safe and <br />efficient traffic movement in the North Kona and South Kona region by <br />granting to the Grantee anon-exclusive easement for the use of the northerly <br />portion of the Mamalahoa Highway Bypass and easterly (mauka) portion of <br />the Haleki'i Street Extension, as described in greater detail in the attached <br />Exhibits, and free of compensation, subject, however, to certain limitations, <br />prohibitions, restrictions, conditions, covenants, promises and other <br />assurances set forth below; and <br />4 <br />
