RESOLUTION AUTHORIZING THE ACQUISITION OF PRIVATE PROPERTIES
FOR PERMANENT EASEMENT PURPOSES FOR THE P AUKAA SEWER
SYSTEM, LOCATED AT PAUKAA, DISTRICT OF SOUTH HILO, COUNTY AND
STATE OF HAWAII
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII
I.
That it is necessary for the public use and purpose, to wit the improvement,
construction, operation and maintenance of the Paukaa sewer system and adjacent lands
for sewer system disposal in connection with the Paukaa sewer system, situate at Paukaa,
District of South Hilo, Island, County and State of Hawaii, to take, acquire and condemn
certain private properties for permanent easement purposes with all improvements
thereon and appurtenances thereunto belonging, free and clear of all liens and
encumbrances, and to that end and for these purposes the Corporation Counsel of the
County of Hawaii be and is hereby authorized and empowered to initiate proceedings in
eminent domain, as provided by Chapter 101, Hawaii Revised Statutes, as amended, for
the taking, acquisition and condemnation of the private properties described in
Exhibits "A" through "s" and shown on location plans marked Exhibits "I" through
"12," all attached hereto and made a part hereof, together with any adjacent private
properties necessary for temporary construction purposes, including but not limited to
temporary easements for construction and operations, storage and disposal areas

That in the process of said proceedings in eminent domain, said Corporation
Counsel be and is hereby authorized and empowered to negotiate terms of settlement,
subject to the approval of the court before which such proceedings are prosecuted.
That the settlement offer must come before the full Council of the County of
Hawaii for review and approval before the construction right-of-entry is permitted.
BE IT FURTHER RESOL VED that the Clerk of the County of Hawaii is directed
to transmit copies of this resolution to the Mayor of the County of Hawaii, the Director
of Finance, and the Chief Engineer of the Department of Public Works.
