<br />"~I -- <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />COUNTY OF HAWAII ':STATE OF HAWAII <br />RESOLUTION <br /> <br />RESOLUTION REQUESTING THE GOVERNOR AND THE LEGISLATURE TO CONVENE A SPECIAL <br />SESSION TO RESOLVE THE PRIV A TIZA TION ISSUE <br /> <br />WHEREAS, for many years, the County of Hawaii and numerous other government agencies in the State <br />have had contracts with private parties to provide services to the public; and <br /> <br />WHEREAS, this system for providing services to the public has been put in turmoil because of the recent <br />decision in Konno v. County of Hawaii, which ruled that government cannot privatize services without the express <br />consent of the Legislature; and <br /> <br />WHEREAS, the Konno decision has spawned different interpretations among the various government <br />agencies, has created confusion for private service providers, and has resulted in extensive litigation in the various <br />Courts. <br /> <br />NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HA WAIl that it <br />requests the Governor and the Legislature to immediately convene a special session of the Legislature to resolve the <br />privatization issue. <br /> <br />BE IT FURTHER RESOLVED that copies of this Resolution be transmitted to Governor Benjamin <br />Cayetano, Senate President Norman Mizuguchi, House Speaker Joseph Souki, Mayor Stephen K.
