<br />:.N~ <br />,- ' _",::'> ~.4 <br /> <br />. <br /> <br />. <br /> <br />COUNTY OF HAWAII <br /> <br />STATE OF HAWAII <br /> <br />RESOLUTION NO. <br /> <br />119 97 <br /> <br />RESOLUTION AUTHORIZING THE ACQUISITION OF PRIVATE PROPERTY FOR <br />PERMANENT EASEMENT PURPOSES FOR THE CONSTRUCTION OF SIDEWALKS <br />ALONG W AINAKU STREET TO IMPROVE SAFETY FOR THE SCHOOL CHILDREN <br />AND OTHER PEDESTRIANS, IN THE DISTRICT OF SOUTH HILO, COUNTY AND <br />STATE OF HAWAII. <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HA WAIl. <br /> <br />1. <br /> <br />That it is necessary for the public use and purpose, to wit: the construction of sidewalks <br /> <br />along Wainaku Street, in the District of South Hilo. Island, County and State of Hawaii, to take, <br /> <br />acquire and condemn certain private property for permanent easement purposes with all <br /> <br />improvements thereon and appurtenances thereunto belonging, free and clear of all liens and <br /> <br />encumbrances, and to that end and for these purposes the Corporation Counsel of the County of <br /> <br />Hawaii be and is hereby authorized and empowered to initiate proceedings in eminent domain, as <br /> <br />provided by Chapter 101, Hawaii Revised Statutes, as amended, for the taking, acquisition and <br /> <br />condemnation of the private properties described in Exhibits "A" through "H" and shown on <br /> <br />location plans marked Exhibits "1" through "5," all attached hereto and made a part hereof, <br /> <br />together with any adjacent private properties necessary for completion of the project and for <br /> <br />temporary construction purposes, including but not limited to temporary easements for <br /> <br />construction and operations, storage and disposal areas. <br />
