<br />. <br /> <br />. <br /> <br />COUNTY OF HAWAII <br /> <br />STATE OF HAWAII <br /> <br />RESOLUTION NO. <br /> <br />124. 97 <br /> <br />RESOLUTION AUTHORIZING THE ACQUISITION OF PRIVATE PROPERTIES FOR <br />PERMANENT EASEMENT PURPOSES FOR THE PAP AIKOU SEWER SYSTEM, <br />LOCATED AT PAPAIKOU, DISTRICT OF SOUTH HILO, COUNTY AND STATE OF <br />HAW All. <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HA WAIl. <br /> <br />1. <br /> <br />That it is necessary for the public use and purpose, to wit: the improvement, <br /> <br />construction, operation and maintenance of the Papaikou sewer system and adjacent lands for <br /> <br />sewer system disposal in connection with the Papaikou sewer system, situate at Papaikou, <br /> <br />District of South Hilo, Island, County and State of Hawaii, to take, acquire and condemn certain <br /> <br />private properties for permanent easement purposes with all improvements thereon and <br /> <br />appurtenances thereunto belonging, free and clear of all liens and encumbrances, and to that end <br /> <br />and for these purposes the Corporation Counsel of the County of Hawaii be and is hereby <br /> <br />authorized and empowered to initiate proceedings in eminent domain, as provided by <br /> <br />Chapter 101, Hawaii Revised Statutes, as amended, for the taking, acquisition and condemnation <br /> <br />of the private properties described in Exhibits "1" through "6," and shown on location plans <br /> <br />marked Exhibits "A" through "F," all attached hereto and made a part hereof, together with any <br /> <br />adjacent private properties necessary for temporary construction purposes, including but not <br /> <br />limited to temporary easements for construction and operations, storage and disposal areas. <br /> <br />- <br /> <br />-. <br />
