(3)7-5-20:073 (PORTION), TO THE COUNTY OF <br />HAWAII. <br /> <br />WHEREAS, WESTP AC DEVELOPMENT VENTURE, a Hawaii limited partnership, is <br /> <br />the developer of the Alii Lani Subdivision, Increment 1, Phase 1, and the owner of the certain <br /> <br />roadway lot located in North Kona, County and State of Hawaii, specifically identified as Tax <br /> <br />Map Key No. (3)7-5-20:073 (portion), being more particularly described in Exhibit A and <br /> <br />delineated on Exhibit B attached hereto; and <br /> <br />WHEREAS, WESTP AC DEVELOPMENT VENTURE has constructed all subdivision <br /> <br />improvements as required for final subdivision approval; and <br /> <br />WHEREAS, WESTP AC DEVELOPMENT VENTURE has received approval from the <br /> <br />County of Hawaii's Department of Public Works, Department of Water Supply and the Planning <br /> <br />Department for the improvements made to the subject property, and are desirous of dedicating <br /> <br />the subject parcel to the County of Hawaii for road and drainage purposes; and <br /> <br />WHEREAS, the subject road and drainage improvements have been completed according <br /> <br />to County of Hawaii standards and are in acceptable condition for dedication; and <br /> <br />WHEREAS, Section 23-10 of the Hawaii County Code requires that the acceptance of <br /> <br />such road and drainage improvements be in compliance with Chapter 23 of the subdivision code; <br /> <br />and <br />
