<br />. <br /> <br />. <br /> <br />. <br /> <br />OJ.\~t\ctt G~ <br /> <br />COUNTY OF HAWAII STATE OF HAWAII <br /> <br />RESOLUTION NO. 140 - 97 <br /> <br />RESOLUTION ACCEPTING LOT 62l3-A, HAWAI'IAN ACRES, PUNA, AS A <br />COUNTY ROAD. <br /> <br />WHEREAS, Lot 62l3-A, as described in the attached Exhibit 1, <br /> <br />which is located in Hawai'ian Acres subdivision in Puna, County of <br /> <br />Hawaii, comprises the main route through the Hawai'ian Acres <br /> <br />Subdivision; and <br /> <br />WHEREAS, Lot 62l3-A in Hawai'ian Acres, by connecting with <br /> <br />Ainaloa Boulevard, is an important component of the proposed "Puna <br /> <br />Emergency Road"; and <br /> <br />WHEREAS, the title to Lot 62l3-A is jointly held by the <br /> <br />owners of approximately 3,400 lots within the subdivision, each <br /> <br />with an undivided interest; and <br /> <br />WHEREAS, no person has exercised any act of ownership over <br /> <br />the road for more than five (5) years; and <br />WHEREAS, the road is not constructed and maintained up to <br />County of Hawaii standards at the present time; and <br />WHEREAS, Hawaii Revised Statutes, Section 264-l(c)(2) <br /> <br />provides that where no act of ownership has been exercised over <br />the road, way or lane for more than five (5) years and, in the <br /> <br />case of a County highway, where the legislative body has accepted <br /> <br />or adopted the same by resolution, the road, way, or lane shall <br /> <br />become a County highway. <br />
