FOR THE <br />KEALAKEHE W ASTEW A TER TREATMENT PLANT. <br /> <br />WHEREAS, Section 10-11 of the County Charter requires that any contract, lease, or <br /> <br />other obligation requiring payment of funds from the appropriations of a later fiscal year or more <br /> <br />than one fiscal year be approved by resolution; and <br /> <br />WHEREAS, by entering into a Rider M, Option B Agreement with HAW All ELECTRIC <br /> <br />LIGHT COMPANY, INC. ("HELCO") for the Kealakehe Wastewater Treatment Plant <br /> <br />("WWTP") facility, the annual electricity cost savings would be approximately $36,420.00 per <br /> <br />year; and <br /> <br />WHEREAS, both a three-year and five-year agreement is required since HELCO is <br /> <br />required to obtain Public Utilities Commission ("PUC") approval for three-year agreements. The <br /> <br />five-year agreement would apply until such time that the PUC approves the three-year <br /> <br />agreement; and <br /> <br />WHEREAS, a sample Rider M Agreement is attached hereto as Exhibit "A". <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF <br /> <br />HAWAII: <br /> <br />1. That the Mayor is hereby authorized to enter into a multi-year Rider M <br /> <br />Agreement with HELCO for the Kealakehe WWTP. <br />
