DERNBACH, TAX MAP KEY (3)4-3-15:009 (PORTION), <br />AND FROM JEROME H. MOONEY, TAX MAP KEY (3)1-8-73:065 (PORTION), TO THE <br />COUNTY OF HA WAIl. <br /> <br />WHEREAS, Timothy A. Dembach is the owner of real property situated at Paauilo <br /> <br />Homesteads, Second Series, District of Hamakua, Island and County of Hawaii, State of Hawaii, <br /> <br />specifically Tax Map Key No. (3)4-3-15:009 (portion), consisting of approximately 1,816 square <br /> <br />feet or 0.042 acre, more particularly described in Exhibit "A" and delineated on Exhibit "B" <br /> <br />attached hereto; and <br /> <br />WHEREAS, Jerome H. Mooney, individually and as Trustee under that certain Trust <br /> <br />Agreement dated June 29, 1990, is the owner of real property situated in the District of Puna, <br /> <br />Island and County of Hawaii, State of Hawaii, specifically Tax Map Key No. (3)1-8-73:65 <br /> <br />(portion), consisting of approximately 0.770 acre, more particularly described in Exhibit "C" and <br /> <br />delineated on Exhibit "D" attached hereto; and <br /> <br />WHEREAS, it is necessary for the County of Hawaii to acquire the above-mentioned real <br /> <br />property to complete replacement of the Oshiro Bridge and Kalopa/Aliipali Bridge, Federal Aid <br /> <br />Project No. BR-0100(49); and <br /> <br />WHEREAS, Timothy A. Dembach and Jerome H. Mooney have graciously donated the <br /> <br />above-mentioned real property to the County of Hawaii; and <br /> <br />WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter provides that the <br /> <br />Council, on behalf of the County of Hawaii, may accept gifts or donations of real property. <br />
